The following chapter, with all ordinances supplementary thereto and amendatory thereof, shall be known as "The Sanitary Code of the Borough of North Caldwell."
As used in this chapter:
BOARD
The Board of Health of the Borough of North Caldwell.
HEALTH OFFICER
The Health Officer of the Borough of North Caldwell.
All garbage, offal, scraps and other refuse shall be kept in watertight containers with tight-fitting covers, and shall be disposed of at least twice a week, but not in any manner which may be offensive or create any unhealthful condition within the borough. No garbage, offal or decaying matter shall be used, either alone or with ashes or dirt, for filling low ground, or in any lot or vacant space.
All vehicles used in the removal of ashes, garbage, refuse and manure shall be kept clean, and shall be covered at all times as completely as may be consistent with proper loading while using the streets of the borough, and they shall at no time be loaded or overloaded in any manner so as to cause the contents to fall on any street.
No person shall have horses, cattle, swine, sheep or fowl in any building used as a habitation for human beings.
No person shall maintain any shed, coop, pen or runway for fowls or rabbits nearer than 30 feet from any door or window of any dwelling, nor shall be keep any shed, coop, pen or runway in an unclean or unsanitary condition.
Any person violating any of the provisions of this chapter shall, upon conviction thereof, be liable to a penalty of not less than $5 nor more than $500 for each offense, and each and every day that such violation continues, after conviction thereof, shall constitute a separate and distinct offense.
