No owner or keeper of any dog shall permit such dog to run at large.
No person shall own, keep, harbor or maintain a dog which habitually barks or cries.
No owner shall permit, suffer or allow any dog to discharge its excreta upon any posted public or private property, grass areas, lawns, stones, and the like, including the property of the owner, except as follows: Dogs must be leashed and curbed, and the owner must immediately clean up such dog's excreta in a proper fashion and make proper disposal of same. "Proper clean-up and disposal" shall require that such owner immediately remove all feces and droppings deposited by such dog, which removal shall be in a sanitary manner by shovel, container, disposal bag or some other similar device, and said feces and droppings shall be removed by said owner and disposed of by said owner in a sanitary manner, so as to prevent any noxious odors, attraction of vermin or any other public health nuisance. In no event shall disposal be effected by deposit into the storm sewer system of the Borough of Wildwood Crest.
A. 
Dogs must be able to move freely when chained or tethered and shall be confined for a total of no more than eight hours within a twenty-four-hour period, with a maximum of four hours at any one interval and a minimum one hour period between confinements. The size of the tether or chain must be a minimum of 15 linear feet and shall remain tangle free. Dogs must be equipped with properly fitted harness or buckle- type collars. The tether or chain shall be constructed of lightweight cable. A doghouse shall be accessible to dogs that are chained or tethered.

No dogs shall be chained after the hour of 11:00 p.m. in the evening.
A. 
No owner, caretaker, guardian or handler shall withhold proper shelter, protection from weather, veterinary care and immune care to any animal. No owner, caretaker, guardian or handler shall fail to provide his or her animal with sufficient food and drinkable water on a daily basis. Food and water must be in an animal food consumption or water consumption type container, feeder or waterer.
B. 
No animal shall be subjected to unnecessary suffering and cruelty such as subjecting the animal to prolonged fear, injury, pain or physical abuse. Interaction with humans and other animals shall not be unreasonably withheld.
C. 
Any violations of this section, in addition to other methods of enforcement provided by law, may be enforced by the issuance of a Notice of Violation by members of the Wildwood Crest Police Department, the Wildwood Crest Borough Code Enforcement Officer(s), the Borough of Wildwood Crest Animal Control Officer, and/or the Borough Clerk.
A. 
Any operator of a motor vehicle who accidentally strikes a dog or cat shall stop and render such assistance to the dog or cat as may be possible, provided it could be accomplished safely and without danger to the motorist, pedestrians or other motorists.
B. 
The operator of a motor vehicle involved in such an accident shall promptly report such injury or death to the appropriate law enforcement agency.

The Animal Control Officer and the Chief of Police and members of the Wildwood Crest Police Department shall be hereinafter referred to as "enforcement officer."
Every person convicted of a violation of this Article shall be liable to a penalty of not less than $100 nor more than $1,250 for the first offense; fines shall be doubled for each subsequent offense, or imprisonment for a term not to exceed 15 days, or both.
