There is hereby established, pursuant to the provisions of N.J.S.A. 40:55D-18, the authority of the Zoning Officer to act as the Administrative Officer to administer and enforce the Chapter
85, Land Development Ordinance, of the Borough of Wildwood Crest.
The responsibility and duty of the Zoning Officer is to administer and enforce Chapter
85, Land Development Ordinance, Articles I-XVI and Article
XIX. The duties of the Zoning Officer shall include, but are not limited to, review of zoning permit applications and issuance of same to include examination of the working plans of proposed land development and construction projects for compliance with local land development ordinances and zoning rules and regulations. Pursuant to Section
85-143, the Zoning Officer shall enforce all zoning regulations to ensure compliance. The Zoning Officer shall administer and enforce ordinance requirement for Certificate of Zoning Use Compliance application pursuant to Chapter
86 of the Code of the Borough of Wildwood Crest.
All applications for land development proposals to include new
building construction, alterations and additions to or within existing
principal and accessory structures, fences, signs, curb cuts, driveways
and parking pads, as well as front yard landscaping and all other
land improvement projects involving lot coverage shall be processed
as follows:
A. A zoning permit application shall be filed with the Land Use Office, along with an "as-is" survey, three copies of proposed plans and the requisite fee and, if required, escrow deposit for site improvement inspection pursuant to Section
39-7.
B. The Zoning Officer shall review the application and make disposition
within 10 business days of receipt of complete application. The Zoning
Officer shall:
(1) Suspend disposition and request additional information in order to
complete the application; or
(2) Deny the application and state the reason, citing sections of the
Land Use Ordinance; or
(3) Sign and issue a zoning permit and three sets of plans shall be stamped
"Approved by Zoning Officer" and signed and dated by the Zoning Officer.
One set shall be retained by the Land Use Office, and two sets shall
be returned to the applicant to be submitted to the Construction Official
with an application for a construction permit.
