A. 
This chapter shall be enforced by a Code Official.
B. 
Private community road and/or unadopted street maintenance.
(1) 
If any private community road or unadopted street shall be in such a state of repair as to be deemed a violation of § 310-3 or 310-5 of this chapter, then in such event a Code Official shall provide notice to the owner and/or developer of the property on which the roadway is located. Such notice shall be served personally upon the owner or the developer of the roadway when practicable. If, after reasonable attempt is made, personal service is not possible, then in such event the Code Official shall mail notice by certified mail to the owner at the last-known address.
(2) 
Upon notice, the owner and/or developer shall be required to repair or replace the roadway within 60 days of receipt of such notice.
C. 
Private community road and/or unadopted street snow and ice removal. Any person who violates § 310-4 of this chapter shall be subject to the penalties set forth in § 310-7 of this chapter.
Any person who shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 and, in default of payment, to imprisonment for a term not to exceed 30 days. Each day that a violation continues shall constitute a separate offense.
This chapter shall not apply to private farm lanes or other private lanes that primarily service single-family detached dwellings, farms, or other non-community-related uses.
All provisions of this chapter are applicable in addition to and in accordance with any and all provisions set forth in Pennsylvania state law and any other rule or regulation duly adopted by the Township.
If any provisions of this chapter should conflict with provisions of Pennsylvania state law, any fire code, or other rule or regulation duly adopted by the Township, the state law, regulation, or fire code shall prevail.
All ordinances or parts of ordinances that are inconsistent herewith are hereby repealed.
If any sentence, clause, section, or part of this chapter is for any reason found to be unconstitutional, illegal, or invalid, such unconstitutionality, illegality, or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections, or parts of this chapter. It is hereby declared as the intent of the Board of Supervisors of Lower Windsor Township that this chapter would have been adopted had such unconstitutional, illegal, or invalid sentence, clause, section, or part thereof not been included herein.
This chapter shall be effective five days after enactment.
