There shall be required of every applicant for permission to open any street surface, sidewalk or curbing in the City of Corning a fee and deposit as set forth from time to time by the City Council in Chapter
A251, Fee Schedule, prior to the issuance of any such permit.
Such deposit shall be retained by the City to ensure that such
applicant shall replace any sidewalk, curb or gutter or pavement so
opened up in the condition the same was prior to its opening by such
permit within 30 days from the granting of such permit, or such longer
time as is given by the Superintendent of Public Works on good cause
shown.
Upon the satisfactory and timely replacement of any such opening
to its condition prior to such opening, so made pursuant to such permit
granted, the City shall refund such deposit to the applicant. But
if such applicant shall fail to make a satisfactory replacement in
the opinion of the Superintendent of Public Works, and within the
proper time, such deposit shall be forfeited by the applicant and
it shall be used by the Department of Public Works to defray the cost
of such replacement by said department. Any cost of such replacement
above the amount of the deposit shall be the responsibility of the
applicant.
