The Planning Board shall from time to time prepare
and may amend a program of capital improvement projects for the municipality
for a period of at least six years, and such program may also include
major projects to be undertaken currently or in the future with federal,
state, county or other public funds or under federal, state or county
supervision.
In preparing the capital improvement program,
the Planning Board shall confer with the Mayor, the chief fiscal officer,
the appropriate municipal officials and agencies and the regional
School Board. Every municipal department, authority or agency shall,
upon request of the Planning Board, transmit to the Board a statement
of all capital projects proposed to be undertaken by the municipality
or by such department, authority or agency during the term of the
program, and the Planning Board shall study, advise and make recommendations
as to the projects so proposed.
Whenever the Planning Board has prepared a capital
improvement program, it shall recommend such program to the governing
body, which may adopt such program with or without modification. Any
modification shall be approved by affirmative vote of a majority of
the fall authorized membership of the governing body, and the reasons
for such modification shall be recorded in its minutes. The first
year of any program so adopted by the governing body shall constitute
the capital budget of the municipality as required by N.J.S.A. 40A:4-43
et seq.
Whenever the Planning Board shall have adopted
any portion of the Master Plan, the governing body or other public
agency having jurisdiction over the subject matter, before taking
action necessitating the expenditure of any public funds incidental
to the location, character or extent of such project, shall refer
the action involving such specific project to the Planning Board for
review and recommendation in conjunction with the Master Plan and
shall not act thereon without such recommendation or until 45 days
have elapsed after such reference without receiving such recommendation.
This requirement shall apply to action by a housing, parking, highway,
special district or other authority, redevelopment agency, school
board or other similar public agency, either state, county or municipal.
