This article shall be known as the "Bristol Township Traffic Controls for Streets and Highways Construction and Maintenance Operations Ordinance."
The Township of Bristol hereby adopts in its entirety the Manual on Uniform Traffic Control Devices, 1988 Edition, except as hereby supplemented and amended by this article or subsequent ordinances, as it controls and regulates the obstruction of the normal flow of traffic by construction or maintenance operations.
This article shall apply to any person, corporation, firm, partnership, unincorporated association, contractor, public utility or any other legally recognized entity that is required pursuant to any utility agreement, Pennsylvania Department of Transportation regulation or Bristol Township ordinance to contact Bristol Township prior to performing work on, under or above roadways located in Bristol Township. Said person, corporation, firm, partnership, unincorporated association, contractor, public utility or other legal entity shall hereinafter be referred to as "operator."
Any operator shall be required to participate in a preconstruction meeting with the Bristol Township Police Department's Traffic Safety Bureau.
A. 
During the preconstruction meeting, the operator is required to submit a plan designating for the safe movement of traffic during the period of construction. The Bristol Township Police Department's Traffic Safety Bureau shall have the authority to require the operator to modify its plans in order to provide for the safest flow of traffic and compliance with the Manual on Uniform Traffic Control Devices, 1988 Edition. No construction or maintenance activity may be conducted until the Traffic Safety Bureau has approved the preconstruction plans. No road crossings or detours shall be permitted unless shown on the preconstruction plan and approved by the Bristol Township Traffic Safety Bureau.
B. 
Prior to or during the preconstruction meeting, the operator shall provide to the Traffic Safety Bureau at least two emergency phone numbers to be utilized in the event of an emergency occurring at the construction or maintenance site. No construction or maintenance activity shall be conducted until the emergency telephone numbers have been supplied to the Traffic Safety Bureau.
In the event that an emergency situation occurs at the construction or maintenance site and, in the opinion of the Bristol Township Police Department's Traffic Safety Bureau, a hazardous condition exists at the construction or maintenance site, and if for any reason emergency contacts cannot be made or the emergency contact person does not respond to the notification by the Bristol Township Police Department to correct the hazardous condition, then Bristol Township may respond to correct such hazardous condition. A reasonable fee to reimburse Bristol Township for the cost of addressing the hazardous condition shall be charged to the person, contractor or utility.
A. 
No operator as defined in § 175-44 of this article shall conduct any construction, maintenance operations or utility work on any roadway within the Township except during the hours of 9:00 a.m. and 4:00 p.m.
B. 
The officer in charge of the Traffic Safety Bureau of the Bristol Township Police Department is hereby authorized to permit construction or maintenance work prior to 9:00 a.m. or after 4:00 p.m. where it is determined by said officer that construction or maintenance operations will not substantially delay traffic or create a hazardous situation.
Traffic directors or flag personnel shall be posted at all construction or maintenance sites when determined by the Bristol Township Police Department that such traffic directors or flag personnel are necessary to provide for the safe and expeditious movement of traffic.
The Bristol Township Police Department shall have the authority to order all work stopped, including but not limited to the removal of equipment and vehicles, the removal of stored material within the right-of-way, ordering the backfilling of open excavations and/or other related work in order to abate any nuisance, rectify a hazardous condition or stop any violation of this article.

Any operator who commits a violation of this article shall, upon conviction thereof, be subject to a fine not to exceed $1,000, plus costs of prosecution, and, in default thereof, shall be imprisoned for a term not to exceed 30 days. Each day a violation continues shall constitute a separate violation.
