[HISTORY: Comes from L.L. No. 61-1979, adopted 7-10-1979, effective 7-16-1979.]
This chapter is enacted in accordance with a policy requirement of the Division of Criminal Justice Services of the State of New York as a prerequisite for the Town Clerk of the Town of Hempstead to apply for and obtain criminal history records of applicants who apply for licenses under chapters herein, which relate to soliciting, peddling, operating taxi cabs and tow cars and other activities requiring an investigation of the applicant before a license is issued.
In order to determine the kind of past conduct which would preclude any applicant from obtaining a license, the following criteria shall aid in such determination:
A.
Where an applicant has been convicted of any offense against any of the laws, ordinances, rules or regulations of the State of New York, County of Nassau, Town of Hempstead or other municipality.
B.
Where an applicant has been found by any court of the State of New York to have practiced any fraud, deceit or misrepresentation in the conduct of any occupation, business or profession.
C.
Where an applicant has had his license, which was duly issued under any of the chapters herein, revoked at any time during the year prior to the time of an application for a renewal thereof.
D.
Where an applicant has had his license, which was duly issued under any of the chapters herein, suspended, and the period of such suspension has not expired at the time of his application for such license.
The Town Clerk shall secure the applicant's fingerprints and his check or money order made payable to the New York State Division of Criminal Justice Services, to cover the cost of searching, and shall thereupon forward the fingerprints and funds in the required amount for the processing and return of a criminal history record.
