The State of New York Office of Mental Retardation and Developmental Disabilities, or any state agencies, has and continues to establish community residential facilities within the Town of Hempstead pursuant to § 41.34 of the Mental Hygiene Law of the State of New York. The Town of Hempstead is desirous of establishing a uniform procedure within the town so that persons living within the area contemplated for a proposed site are insured of an expeditious notification thereof.
A. 
The Town of Hempstead, within 10 days after receipt of the official notice from the State of New York Office of Mental Retardation and Developmental Disabilities that a community residence site is being proposed within the town, outside of an incorporated village, shall notify by letter those persons residing within a three-hundred-foot radius in all directions of the proposed community residential facility.
B. 
The Town of Hempstead shall publish for two consecutive weeks in a newspaper having a general circulation within the town and a newspaper having a general circulation in the community in which the proposed community residential facility is proposed a legal notice containing site address, description of property, agency sponsor, client characteristics, total number of residents and support programs, as well as the terms and provisions of § 41.34 of the Mental Hygiene Law of the State of New York. In addition, the town shall give said notice to the local school board or boards within 15 days after receipt of the official notice from the State of New York.
