Editor's Note: This local law repealed former Ch. 122, Sunday Exhibitions, adopted 5-17-1960 by Ord. No. 23-A.
All public sports, exercises or shows upon the first day of the week, and all noise unreasonably disturbing the peace of the day, are prohibited, except as hereinafter provided.
Notwithstanding the provisions of § 122-1 of this chapter, it shall be lawful to conduct, witness, participate in or engage in on the first day of the week after 1:05 p.m. and prior to 11:00 p.m., any form of public sports, exercises or shows which are conducted or engaged in primarily for the entertainment of spectators by a nonprofit educational institution or a religious, philanthropic, fraternal, agricultural or professional corporation or society or any other nonprofit corporation or association, provided such sport, exercise or show is conducted under the immediate and direct supervision and control of such institution, corporation, society or association and that all other provisions of any other applicable ordinance of the Town of Hempstead or any other governmental body having jurisdiction thereover are complied with.
The provisions of this chapter to the contrary notwithstanding, such exhibitions, public sports, exercises or shows shall not be prohibited in a municipally owned stadium, arena or facility after 1:05 p.m. on the first day of the week.
Nothing contained herein shall be deemed to prohibit private sports, games or recreational activities which are engaged in primarily for the personal enjoyment, recreation and health of the participants, on the first day of the week, conducted in a manner which does not constitute a serious interruption of the repose or religious liberty of the community.
Any person or persons, association or corporation committing an offense against this chapter, or any section or provision thereof, is guilty of a violation punishable by a fine not exceeding $250 or imprisonment for a period not exceeding 15 days for each such offense, or by both such fine and imprisonment.
