Editor's Note: Legislative findings adopted with this article make the following declaration:
"It is hereby declared and found that the unrestricted operation of seaplane upon the waters and the waterways within the Town of Hempstead constitutes a problem affecting the public health, safety and general welfare of the residents of the Town of Hempstead and consequently should be subject to supervision and regulations unique to such craft and not common to utilization of said waters and waterways by other types of crafts."
The following rules and regulations shall apply to all waters or waterways within or adjacent to the Town of Hempstead or subject to its jurisdiction, except when prohibited by the laws of the United States and except the channel system under the supervision of the Long Island State Park Commission.
All provisions of the laws of this state and of Congress relative to the use and operation of aircraft shall be complied with by all seaplanes navigating and using the said waterways.
As used in this article, the following terms shall have the meanings indicated:
CHANNEL SYSTEM
Main channels, cross channels connecting with them, basins and bathing areas.
EMERGENCY
A situation or circumstance endangering the life or the limb of the pilot or the passengers of a seaplane.
SEAPLANES
Includes aircraft of every description having attached thereto devices or contrivances which permit the takeoff and landing from or to the water.
No seaplane shall take off or land upon any portion of the channel system of the Town of Hempstead, except in case of an emergency as defined by § 155-12.
