Editor's Note: Legislative findings which accompanied this chapter as Section 1.0 made the following declaration:
"It is hereby declared and found that swimming from docks and bulkheads owned by the Town of Hempstead is a matter affecting the public interest and consequently should be subject to supervision and administrative control for the purpose of safeguarding the public."
Unless otherwise expressly stated, the following words shall have, for the purpose of this act, the meaning herein indicated.
BULKHEAD
Any natural or artificial structure or partition used as a limiting wall along the waterfront.
DOCKS
Any natural or artificial inlet or hollow in which a boat or vessel can be received.
PIER
A structure built out into the water with piles, alongside which a boat or vessel may lie.
SWIMMING FROM
To jump, dive or lower oneself off a dock, wharf, pier or bulkhead into the water.
TOWN-OWNED
The owning, leasing, renting, operating, controlling or maintaining of any dock, wharf, pier or bulkhead by the Town of Hempstead.
WHARF
Any natural or artificial structure of timber, masonry, cement, earth or other material built or located on the shore of a harbor, river, canal or the like so that vessels may lie close alongside to receive or discharge passengers, cargo, etc.
No person shall at any time swim from a Town-owned dock, wharf, pier or bulkhead.
Any person or persons, association or corporation committing an offense against this chapter, or any section or provision thereof, is guilty of a violation punishable by a fine not exceeding $250 or imprisonment for a period not exceeding 15 days for each such offense, or by both such fine and imprisonment.

The administration and enforcement of this chapter shall be under the jurisdiction of the Director of Conservation and Waterdays, subject to the direction of the Town Board; additionally, the Police Department of the County of Nassau shall also have the power to issue summonses for violation of any provision of this chapter.
