Every solicitor, door-to-door salesperson, hawker and peddler
in the Town of Hopedale shall be bound by these regulations except
insofar as they may be, in a particular instance, in conflict with
any specific provision of the General Laws of the commonwealth or
provision of the Constitution of the commonwealth or of the United
States.
Every solicitor, door-to-door salesman, hawker or peddler shall
register with the Town of Hopedale and obtain a permit from the Chief
of Police prior to engaging in any solicitation or sales activity.
Every registration application under this bylaw shall be on
a form approved by the Chief of Police and shall include the following
information:
A. The name, permanent address and telephone number, if any, of the
applicant.
B. The name of the organization the applicant is representing, if any.
C. The permanent address of the organization the applicant is representing,
if any, its telephone number and the name of the person to contact
within such organization for details concerning solicitation or sales.
D. The purpose of the solicitation or the nature of the business to
be conducted, including a list of items to be sold or distributed.
E. The estimated time during which such person will be engaged in the
activity within the Town of Hopedale.
Applications for permits shall be made not less than 48 hours
in advance, except for good and reasonable cause, the determination
of which shall be made at the sole discretion of the Chief of Police
or his designee.
The hours of operation shall be limited to the period between
9:00 a.m. and 8:00 p.m.
No permittee shall enter upon private property where prohibited
by the owner or person in control thereof from so doing either by
sign or by any other manner.
Every permittee representing an organization shall carry proper
identification signifying his relationship to such organization and
shall display the same upon request.
Violations of this bylaw shall be punished by a fine not to
exceed $200, except insofar as the provisions of Chapter 101 of the
General Laws may provide for a lesser fine with respect to hawkers
or peddlers, in which event the provisions of such statute shall be
controlling.
