There is hereby established a park and playground
in the Borough of Pleasant Hills of all of that area of land more
particularly described as follows, to wit:
A. BEGINNING at a point on the southerly line of Lot
No. 843 in the Pleasant Hills Plan of Lots No. 7, of record in the
Recorder's Office of Allegheny County, Pennsylvania, in Plan Book
Vol. 36, pages 58 to 61 inclusive, said point being common the line
dividing lands now or late of A. J. Farrell and the land of H. A.
Beam; thence along the southerly line of Lot No. 843 in said Plan,
North 83º 38' East a distance of One Hundred Fifty-four and 90/100
(154.90) feet to a point on the southwesterly side of Bruceton Road
(Fifty (50) feet wide), (Said Bruceton Road having been dedicated
by Deed of Dedication of record in the Recorder's Office of Allegheny
County, Pennsylvania, in Deed Book Vol. 36, pages 58-61); thence along
the southwesterly side of Bruceton Road by a line curving to the left
in a southeasterly direction having a radius of Three Hundred Ten
(310) feet, a arc distance of Thirty-three and 61/100 (33.61) feet
to a point; thence continuing along the southwesterly side of Bruceton
Road, South 50º 58' East a distance of Three Hundred Sixty-two
and 68/100 (362.68) feet to a point in the westerly line of property
now owned by the Borough of Pleasant Hills, which land is used for
sewage treatment plant purposes (formerly and before date of the Borough
incorporation owned by the Township of Jefferson); thence along the
Westerly line of property owned by the Borough of Pleasant Hills South
23º 22' West a distance of One Hundred Eighty-seven and 58/100
(187.58) feet to a point; thence by a line curving left in a southeasterly
direction having a radius of Six Hundred (600) feet, an arc distance
of Two Hundred Forty and 29/100 (240.29) feet to a point; thence continuing
along said line South 66º 38' East a distance of Twenty-six and
10/100 (26.10) feet to a point; thence continuing along said line
North 23º 22' East a distance of One Hundred Twenty and 30/100
(120.30) feet to a point on the Southwesterly side of Bruceton Road
aforesaid; thence along the southwesterly side of Bruceton Road aforesaid
South 40º 18' 10" East a distance of Forty-six and 61/100 (46.61)
feet to a point; thence continuing along the southwesterly side of
Bruceton Road aforesaid by a line curving to the left in a southeasterly
direction having a radius of Five Hundred Twenty-five (525) feet,
an arc distance of One Hundred Ninety and 81/100 (190.81) feet to
a point; thence continuing along the southwesterly side of Bruceton
Road aforesaid South 60º 7' 35" East a distance of Three Hundred
Eighty-eight and 13/100 (388.13) feet to a point; thence continuing
along the southwesterly side of Bruceton Road aforesaid by a line
curving to the right in a southeasterly direction having a radius
of Seven Hundred Fifty (750) feet, an arc distance of One Hundred
Seventy-three and 02/100 (173.02) feet to a point; thence leaving
Bruceton Road aforesaid and by a line South 40º 44' 30" West
a distance of Four Hundred Twenty-six and 44/100 (426.44) feet to
line of land now or formerly of D. B. Logan; thence continuing along
the line of land now or late of D. B. Logan North 51º 36' 50"
West a distance of One Thousand Eighty-five (1085.00) feet to a point;
thence still continuing along the line of lands now or late of D.
B. Logan by a line South 33º 12' 10" West a distance of Five
Hundred Seventy-one and Ninety-five (571.95) feet to a point common
to line of land now or late of M. Razumic; thence along line of land
now or late of M. Razumic North 38º 31' West a distance of Five
Hundred Forty-eight and 34/100 (548.34) feet to a point in the line
of lands now or late of R. J. Askin; thence along the line of lands
now or late R. J. Askin, North 50º 26' East a distance of Fifty-five
(55) feet to a Black Oak; thence continuing along the line of lands
now or late of R. J. Askin North 69º 1' 40" East a distance of
Five Hundred Fifty-six and 70/100 (556.70) feet to a point; thence
still along the line of lands now or late of R. J. Askin and as same
goes along the line of land now or late of H. A. Beam North 21º
46' 30" West a distance of Three Hundred Forty-six and 74/100 (346.74)
feet to a point at the place of beginning and containing Sixteen and
202/1000 (16.202) acres.
B. In addition to those areas specifically identified in §
254-1A, the rules and regulations and regulated uses defined in Chapter
254 of the Code of the Borough of Pleasant Hills shall also apply on all public land within the Borough of Pleasant Hills, including, but not limited to, all land owned by the Borough. From the date of enactment of this subsection, the prohibited uses defined in §
254-4 of the Code and the regulated uses defined in §
254-5 of the Code shall apply to all areas within the Borough as described herein.

Said land is hereby taken as a park and playground
by the Borough of Pleasant Hills in accordance with the authorization
contained in the provisions of law for the exercise of eminent domain
by the Boroughs of the Commonwealth of Pennsylvania; and the proper
officers are hereby authorized to enter upon and use the same for
the purposes of this taking.
If damages are not agreed upon, the Borough
Solicitor is directed to petition the Court of Common Pleas of Allegheny
County, Pennsylvania, for the appointment of viewers for the assessment
of same. The Borough Solicitor is further empowered and authorized
to do any matter or thing necessary for the accomplishment of this
taking.
