A. 
The purpose of the R-4 District is to reserve areas within the Borough for higher density multifamily buildings not exceeding eight stories in height consistent with the overall pattern of development in the Borough.
B. 
In this district, the land may be used and buildings and structures may be erected, altered or used for the following purposes and no other:
(1) 
Permitted uses.
(a) 
Essential services.
(b) 
Accessory uses customarily incidental to any of the permitted or conditional uses authorized in this district.
(2) 
Conditional uses.
(a) 
Multifamily dwellings, subject to the requirements of § 374-22 and the following express standards and criteria:
[1] 
A minimum site area of two acres shall be required.
[2] 
The site shall have direct access to an arterial or collector road as defined in this chapter.
[3] 
Multifamily buildings which are three stories or less in height shall contain no more than 24 dwelling units in one building.
[4] 
Multifamily buildings which are more than three stories in height shall contain no more than 100 dwelling units in one building.
[5] 
Streets within the plan shall be designed to discourage through traffic and ingress/egress to and from the site shall be designed to minimize congestion, ensure safety and accommodate peak traffic without hazard or great delay.
[6] 
Adequate accessibility for emergency vehicles shall be provided to all residential buildings.
[7] 
Parking areas shall be located within 200 feet of the units that they are intended to serve. Pedestrian walkways shall be provided to link parking areas with dwelling units and common areas, if any.
[8] 
A buffer area, as defined by this chapter, shall be provided along all property lines which adjoin single-family development or single-family zoning classification. The buffer area shall be at least 15 feet in depth as measured from the property line.
[9] 
Slopes in excess of 40% shall be considered unsuitable for construction of residential buildings. Plans for construction of residential buildings on slopes in excess of 25% shall be accompanied by a certification by a registered professional engineer regarding adequacy of foundation design.
[10] 
Plans which contain in excess of 50 dwelling units shall provide active and/or passive recreation appropriate to the needs of the residents subject to the approval of Borough Council. Provision of the approved open space and/or recreation shall be a condition precedent to the issuance of occupancy permits in the plan.
[11] 
The method of organization proposed to operate and maintain the common facilities or common areas in the plan, if any, shall be specified in the conditional use application.
[12] 
Due consideration shall be given in the design of the plan to the preservation of natural features, including large trees, groves, waterways, floodplains, steep slopes, historic points and other community assets.
[13] 
Security lighting of parking areas and other common areas or facilities shall be provided and shall be shielded from adjacent properties.
In this district, the following area and bulk regulations shall apply to the uses permitted:
A. 
Multifamily dwellings.
(1) 
Maximum dwelling unit density:
(a) 
Developments containing buildings three stories or less only: 13 units per acre.
(b) 
Developments containing buildings four stories or more only: 30 units per acre.
(c) 
Developments containing a mix of both types of multifamily buildings: 24 units per acre.
(2) 
Minimum lot area per dwelling unit:
(a) 
Residential buildings three stories or less: 3,350 square feet.
(b) 
Residential building 11 stories or more: 1,450 square feet.
(3) 
Maximum lot coverage: 35%.
(4) 
Minimum front yard:
(a) 
Residential building three stories or less (all principal and accessory structures): 35 feet from property line, not less than 65 feet from center line of state or county road and not less than 60 feet from center line of Borough street.
(b) 
Residential buildings four stories or less (all principal and accessory structures): 50 feet from property line, not less than 80 feet from center line of state or county road and not less than 75 feet from center line of Borough street.
(5) 
Minimum rear yard:
(a) 
All principal structures three stories or less:
[1] 
Yards adjoining single-family use or zoning: 50 feet.
[2] 
All other yards: 30 feet.
(b) 
All principal structures four stories or more:
[1] 
Yards adjoining single-family use or zoning: 75 feet.
[2] 
All other yards: 50 feet.
(c) 
All accessory structures: 10 feet.
(6) 
Minimum side yards:
(a) 
All principal structures three stories or less:

[2] 
All other yards: 20 feet.
(b) 
All principal structures four stories or more:
[1] 
Yards adjoining single-family use or zoning: 75 feet.
[2] 
All other yards: 30 feet.
(c) 
All accessory structures: 20 feet.
(7) 
Minimum distance between buildings. For developments containing more than one multifamily building on one lot, the following minimum requirements for distance between buildings shall apply:

Borough Council shall hear and decide applications for conditional uses in accordance with the procedures specified in § 374-118 of this chapter.
