As used in this article, the following terms shall have the following meanings:
RESIDENT
A person who occupies real estate within a residential district as his or her principal residence.
RESIDENTIAL AREA
A contiguous or nearly contiguous area containing public highways or parts thereof abutted by residential property.
RESIDENTIAL PARKING PERMIT AREA
A residential area where curbside parking on public highways is restricted as set forth in this article on specified days during hours fixed by the Township Manager and, as the case may be, by the Board of Supervisors to not more than a certain number of consecutive hours unless the vehicle properly displays a parking permit authorized by this article.
A. 
The Board of Supervisors is hereby empowered to determine whether a residential area, or portion thereof, may be designated or may continue to be designated a residential parking permit area. The decision of the Township Manager and the Board of Supervisors shall become effective by ordinance.
B. 
The residential areas designated by the Board of Supervisors are eligible for a residential parking permit program, provided that the following requirements are met:
(1) 
The Board of Supervisors shall, by motion, vote whether to designate the residential area or portion thereof under consideration as a residential parking area, and, if the area be so designated, the Board shall, in such ordinance and in accordance with § 170-42, fix the hours and days when the restriction on curbside parking by persons shall be in effect.
(2) 
Public notice to residents of the designation of the residential parking permit area shall be given in the manner set forth in § 170-43.
A. 
Within a designated residential parking permit area, curbside parking on public highways by persons without permits shall be limited to not more than one or two hours, as the case may be, between 8:00 a.m. and 6:00 p.m., Monday through Friday, excluding holidays falling between Monday through Friday, or between the hours specified in § 170-47 hereof. The Board may change the times of parking or the days of parking based on the circumstances of the curbside parking needs of the particular residential area involved.
B. 
After designation of a residential parking permit area, the hours of the day during which the restriction on curbside parking by vehicles without permits shall be in effect, shall be subject to change from time to time upon recommendation by the Township Manager and the Board of Supervisors.
Following the Board of Supervisors affirmative vote to designate a residential parking permit area pursuant to § 170-41, the Township Manager, or his designee, shall publish two times in a newspaper of general circulation in this Township, a notice containing the following:
A. 
The existence, exact location and numerical designation of the parking permit area.
B. 
The parking restrictions applicable to all vehicles in curbside parking spaces along public highways in the designated area which do not properly display a parking permit authorized by this article.
C. 
The procedures to obtain information regarding the acquisition of permits.
A. 
A residential parking permit shall be issued on the basis of one permit per vehicle registered to an address in the approved area, up to a maximum of four vehicles per household. The application for the residential parking permit shall contain the following information:
(1) 
The name and residential address of the owner of the vehicle.
(2) 
The make, model and registration number of the vehicle.
(3) 
The signature of the applicant for the residential parking permit.
B. 
Upon the applicant's submission of a completed and validated residential parking permit application and applicant's fulfillment of all applicable provisions of this article controlling issuance of the residential parking permit, the Township shall issue and the applicant shall receive one residential parking permit for the vehicle described in the application. Such residential parking permit shall be prominently displayed in the front left side of the windshield, or in such other place as the Township Manager may direct in writing. A vehicle shall be issued a residential parking permit only if it displays a valid state license and current inspection certificate.
A. 
A parking permit shall not guarantee or reserve a parking space within a designated parking permit area. A parking permit shall not authorize the standing or parking of any vehicle in such places and during such times as the stopping, standing or parking of vehicles is prohibited or set aside for specified types of vehicles and shall not excuse the observance of any traffic regulation other than the parking time limit enforced in the residential parking permit area.
B. 
Whenever the holder of a parking permit or the vehicle for which the parking permit was issued no longer fulfills one or more of the applicable provisions of this article controlling issuance of parking permits, the holder shall notify the Township which then shall direct the holder to surrender the parking permit. Until its surrender or revocation, a parking permit shall remain valid for such time as the holder continues to reside within the designated residential parking permit area.
C. 
A parking permit shall be valid only in the parking permit area for which it is issued. It shall be a violation of this article for the holder of a parking permit to fail to surrender it when directed to do so by the Township. It shall be a violation of this article for any person to represent in any fashion that a vehicle is entitled to a parking permit authorized by this article when he or she is not so entitled. The display of a parking permit on a vehicle not entitled to such a parking permit shall constitute a representation. It shall be a violation of this article for any person to duplicate, by any means, a parking permit authorized by this article. It shall be a violation of this article for any person to display on any vehicle such a duplicate parking permit.
Upon application of any resident of a residential parking permit area, the Township shall issue a visitor parking permit to the resident for a visitor's vehicle, to be limited to the residential parking permit area in which the applicant resides. For purposes of this section, the resident shall be the holder of and responsible for the use and misuse of the visitor parking permits issued to him or her. The visitor permit is to be used only when visitors are actually visiting the household to which the permit was issued. Any violation of the permitted use of the visitor permit shall be grounds for the immediate termination of the permit. Any violation shall be determined solely by the Township.
Any person who violates § 170-45 or § 170-46 of this article shall pay a fine of $25. Provided, however, that it shall be the duty of Township police officers and of Township parking enforcement personnel to report to the Magisterial District Judge all violations of § 170-45 and § 170-46 and, in each case, the section violated, the license number of the vehicle involved in the violation, the location where the violation took place, and any other facts which might be necessary in order to secure a clear understanding on the circumstances attending the violation. The police officer or other person making the report shall also attach to or place upon every such vehicle a notice stating that the vehicle was in violation of § 170-45 or § 170-46, as the case may be. Any person violating any other provision of this article or the regulations promulgated hereunder shall, upon conviction thereof in a summary proceeding, be fined $25 for each violation and, in default of payment of any fine so imposed, shall be imprisoned for a period not to exceed 10 days for each violation.
