It shall be the duty and responsibility of every
owner of property and every person occupying a dwelling unit, premise
or place of business within the Borough where municipal waste is produced
and is accumulated to pay a service fee for the collection and disposal
of this waste, except as otherwise provided by this chapter, to a
contracted hauler. The owner and/or occupant of any dwelling unit,
including multifamily establishments, shall pay a base quarterly fee
regardless of the amount or type of waste put out for collection.
The exclusive contractor may discontinue service for nonpayment of
quarterly fees by a resident, commercial, institutional or industrial
establishment. Vacant properties containing a dwelling unit or units
are considered dwelling units subject to a minimum quarterly bill
for availability of trash services. This minimum bill shall be equivalent
to a one-quarter bill per vacant property and is considered a standby
fee.
To encourage and maximize recycling and waste
reduction, all quarterly waste fees paid either to a municipal waste
collector, or an exclusive contractor shall be based upon the volume
of waste collected at dwelling units to the extent than any amount
over three thirty-five-gallon cans or bags per week be charged on
a volume basis through the use of tags sold directly to the resident
by the Borough for use on excess cans or bags. In addition, the Borough
may add a quarterly surcharge to each residential unit to cover the
Borough's administrative costs. Commercial, industrial and institutional
facilities that utilize bags or cans to dispose of their waste are
also subject to a three-bag or can amount per week. The only exceptions
are those facilities that utilize dumpster-type service or those facilities
that are not part of the Steelton Borough Solid Waste Program. To
effectuate this provision, the following guidelines are hereby established:
A. Haulers shall be required to file with the Borough
a complete schedule of rates showing evidence that their rates are
established on a volume basis, and said rates shall be annually for
the length of the contract.
B. An exclusive contract for the collection of residential
municipal waste that may be established by the Borough shall include
provisions for billing residential units on a volume basis by the
exclusive collector. These provisions shall not preclude the Borough
or its collector from establishing a minimum charge for solid waste
collection as an assessment against the property for the benefit to
the health and welfare of the community for having a comprehensive
solid waste collection program available to the owners of property
in the Borough. Such minimum charges will be set at a level that is
approximate to cover the basic cost of solid waste collection but
shall not be set so high as to discourage recycling of solid waste.
All quarterly fees established under an exclusive
contract for the collection of waste by the exclusive contractor shall
be established by a resolution of the Council of Steelton Borough.
Any surcharge(s) so established shall be reviewed at least annually
and adjusted as necessary to ensure that all costs involved in the
collection and disposal of municipal waste under the exclusive contract,
including the administrative costs of the Borough are covered by the
surcharge(s).
