Any person violating any of the provisions of this chapter shall, upon conviction by a District Magistrate,[1] be subject to a fine of not less than $100 nor more than $1,000, together with the cost of prosecution, or, in default of payment of such fine, imprisonment in the Dauphin County Jail for a period of not more than 30 days. Every violator of the provisions of this chapter shall be deemed guilty of a separate offense each and every day such violation continues and shall be subject to the penalty imposed by this section for each and every separate offense.

In addition to the foregoing penalty, the Borough may require the owner or occupant of a property to remove any accumulation of solid waste, and should said person fail to remove any accumulation of solid waste and should said person fail to remove such solid waste after five days following written notice, the Borough may cause the solid waste to be collected and disposed of with the cost for such action to be charged to the owner or occupant of the property in a manner provided by law. The Solicitor of the Borough is authorized to institute proceedings in courts of law or equity to control the collection, storage, transportation, processing, treatment and disposal of solid waste to enforce the provisions of this chapter, including securing injunctive relief to prohibit any unlicensed or unauthorized person or any licensed or authorized collector in violation of the provisions of this chapter from continuing collection, transportation or disposal under the terms hereof, or to enforce compliance by any licensed collector with the terms of this chapter.
