Except as otherwise provided in this chapter, no person, either directly or indirectly, by employing or engaging others, shall throw, drop or place, or cause to be thrown, dropped or placed, any sign, poster, sticker, circular, bill, handbill, advertising circular, paper or wastepaper of any kind upon any street, driveway, alley, sidewalk, sewer, park, street sign or other public place; upon a porch, lawn, stoop, piazza or step, or in a yard, of any house, apartment, institution or business; in a vehicle parked along a street or in a driveway, alley or parking lot; or on a utility pole.
A. 
Newspapers, advertisements, handbills or circulars subscribed to by a resident of the Borough or a property owner therein are exempt from § 61-1 hereof, provided that each such resident or property owner provides a suitable place for receipt of such newspapers, advertisements, handbills or circulars so that they may not be blown or carried away, thereby creating a nuisance.
B. 
Advertising circulars or papers may be distributed by a commercial business, provided that such business obtains the necessary license and permits required, as set forth in § 61-4 hereof, and that all circulars or papers are placed in a suitable location so that the circulars or papers may not be blown or carried away, thereby creating a nuisance.
C. 
Political posters or signs may be placed in suitable locations, provided that there are not more than 100 such posters or signs per candidate and/or political party, in the Borough. Such posters or signs may not be displayed more than three weeks prior to a primary, general or special election and must be removed within 10 days after such election.
D. 
Posters or signs advertising events for a nonprofit organization situated wholly or partially in the Borough may be placed in suitable locations, but are not to exceed 15 per event, or exceed 15 at any one time by such organization in case of multiple events. Posters or signs may not be displayed more than three weeks prior to the event and must be removed within 10 days after the completion of the event.
E. 
Posters or signs advertising events for a nonprofit organization situated outside the Borough may be permitted, provided that such organization makes application to Council for a waiver and Council grants such waiver at a public scheduled Council meeting. Posters or signs shall not exceed 10 at any one time, or per event, shall not be displayed more than three weeks prior to the event and shall be removed within 10 days of the completion of the event.
F. 
Nothing contained in this section shall grant or convey the right to violate any other ordinance or statute, or part thereof.
The use of glue or poster or similar type adhesive is prohibited.
A. 
Each individual, business, firm, association or other person who or which distributes circulars, handbills, advertisements, newspapers and other materials must obtain a license therefor. Such license shall be issued by the Code Enforcement Officer for each calendar year or portion thereof. The annual license fee shall be $300.
B. 
At the time the license application is made, the applicant must provide a written list of all individuals, businesses, firms, associations and other persons for whom or which materials will be distributed. Thereafter, on or by April 30, August 30 and November 30 of the applicable year, the licensee shall provide an updated list to the Code Enforcement Officer.
C. 
An application for the annual license and payment of the fee shall be made prior to the distribution of any materials in the calendar year.
D. 
Any distributor who would otherwise be required to obtain a license pursuant to Subsection A hereof may, in the alternative, apply for a permit. Permits shall be issued by the Code Enforcement Officer and shall allow the holder of the permit to distribute materials on one specified day. The fee for such a permit shall be $25.
E. 
At the time the permit application is made, the applicant must provide a written list of all individuals, businesses, firms, associations and other persons for whom or which materials will be distributed.
Political parties and nonprofit organizations are exempt from all license, license fee and permit fee requirements of § 61-4 hereof. Permits, however, are required. Newspapers of general circulation which are subscribed to by those receiving such newspapers are not subject to the fee provisions of § 61-4 hereof.
A person who fails to remove a poster or sign after the time set forth therefor in this chapter does hereby grant to the Borough the right to remove such poster or sign. Such person hereby further agrees to pay to the Borough $2 for each poster or sign removed or picked up and an administrative fee of $25 for preparation of the bill.
A. 
All materials distributed must be placed upon each property of the resident or business to which they are distributed in a manner that will prevent the material from being carried by the wind.
B. 
The materials shall not be placed upon lawns, bushes, trees or other vegetation of the property of the residence or business to which the materials are being distributed.
C. 
The materials shall not be placed on or about any motor vehicle.
D. 
The materials shall not be placed upon any property on which two other circulars, handbills, advertisements, newspapers or other materials have previously been placed and remain.
E. 
The materials shall not be placed where they could be a hazard to any pedestrian.
A. 
Each circular, handbill, advertisement, newspaper and other material that may be distributed shall contain identification, including the name and address of the entity distributing the same.
B. 
The individual, business, firm, association or other person whose product, business, goods or services are being advertised or promoted by the distribution shall make certain that Subsection A hereof is complied with. If the identification of the distributor is not disclosed on the distributed materials, each individual, business, firm, association or other person whose product, business, goods or services are being advertised or promoted shall be liable for all fines and penalties that may be imposed on the distributor pursuant to this chapter and shall be subject to prosecution.
Whoever violates or fails to comply with any of the provisions of this chapter shall be fined not less than $100 nor more than $1,000.
