GENERAL REFERENCES

As used in this chapter, the following terms shall have the meanings indicated:
SENSITIVE AREA
Any neighborhood within the Borough from which the Pennsylvania Human Relations Commission has received, within a period of one month, a substantial number of complaints of violations of the provisions of the Pennsylvania Human Relations Act;[1] or in which the number of houses for sale, as evidenced by "for sale" signs exhibited on the premises thereof, exceeds 15% of the houses in any block of such neighborhood; or which has been declared a "sensitive area" by the Pennsylvania Human Relations Commission and/or the Borough Community Relations Committee; or where Council determines that the level of solicitation is such that it jeopardizes the Borough remaining an integrated community or such that it constitutes harassment; or where individuals are undergoing harassment, threats or violence as the result of their enjoying the benefits afforded by the Pennsylvania Human Relations Act.
SOLICIT
Any contact in connection with real property, including, but not limited to, printed matter mailed or delivered to the owner or occupant of real property by any person, real estate broker, salesperson or agent or representative of any such broker, salesperson or agent; or any oral communication made either in person or by telephone to the owner or occupant of real property by any person, real estate broker, salesperson or agent which advertises the accomplishments and/or abilities of the real estate broker, salesperson or agent to sell real property or rent apartments or furnish services in connection therewith, or requests or suggests that the owner or occupant list real property for sale or rental with the real estate broker, salesperson or agent, or which offers to purchase or rent the owner's house or apartment, or which offers to furnish services in connection therewith. "Solicit" also includes any form of contact by a person, real estate broker, salesperson or agent or representative thereof with an owner in a public place with the intent to accomplish the aforesaid solicitation, including, but not limited to, solicitation on the street, in the neighborhood affected, the placing of cards on the windshields of automobiles in the area and the distribution of gifts, donations and the like in connection with bazaars or other public gatherings.

No person shall:
A. 
Display a sign or any other device representing that real property is available for inspection, sale, lease, sublease, rental, assignment or other transfer when in fact it is not so available, or that such real property has been sold or rented when in fact it has not been sold or rented.
B. 
Do or conspire individually and/or severally to manufacture, create, incite, compel, coerce or assist in the creation of incidents designed to create panic selling of real estate, including, but not limited, to:
(1) 
Increasing real estate transactions or publishing reports of such an increase not based on facts;
(2) 
Creating false and misleading advertising which represents that properties in an area are being sold, rented or transferred when they are not; and
(3) 
Increasing the volume of solicitation in sensitive areas.
C. 
Represent to a prospective buyer or seller that a change will or may occur on the block or in the neighborhood as to the race, color, sex, religion, national ancestry or income of the occupants, or that the change will or may alter property values or in other ways decrease the desirability of the block or neighborhood or the availability of municipal services to the area.
D. 
Solicit for the transfer of housing or discourage the listing, sale, rental or transfer of housing by representations such as those listed in Subsection C hereof.
E. 
Solicit any property for the sale, transfer or rental of such property or the furnishing of any service in connection therewith, after notification that the owner of the property does not desire to be solicited, provided that such notice was not given for the purpose of avoiding compliance with the Pennsylvania Human Relations Act or a comparable statute.
F. 
Discriminate in any manner against another person because such person has opposed an unlawful practice defined in the Pennsylvania Human Relations Act, or because such person has made a charge or testified, assisted or participated in any manner in any investigation, proceeding or hearing under a provision of the Act or enjoyed the benefits thereof; or solicit sales or listings in any sensitive area or have another person so solicit on his or her behalf in such sensitive area.
Any person violating the provisions of this chapter shall, upon conviction, be subject to the penalties set forth in Chapter 1, General Provisions, Article II, of this Code.
