Written application for the use of Borough buildings and grounds shall be made to the Borough Manager on a form approved by Council. The application shall contain the name, address and telephone number of the applicant, the specific Borough building and/or grounds or parts thereof the applicant desires to use, the date and time the applicant desires to use the Borough's buildings and grounds, the number of people expected to use the Borough's buildings and grounds at the requested time, the name and address of the individual to whom all communications should be sent and the purpose for which the applicant desires to use the Borough's buildings and grounds. The application shall be signed by the responsible officer of the applying organization. Upon signing the application, the applicant agrees to be bound by the provisions of this chapter and any other rules and regulations governing the use of the Borough's buildings and grounds which Council may adopt from time to time. Council reserves the right to designate which Borough buildings and grounds or parts thereof are available for use.
All applications are subject to prior approval of Council, and Council further reserves the right at any time to cancel any application, approval of which may have been given.
The organization requesting the use of the Borough's buildings and grounds acknowledges and verifies by the signing of the application that it does not discriminate against any individual because of his or her race, color, religious creed, ancestry, sex, age, national origin, handicap or disability.
Requests for use of the Borough's buildings and grounds shall be denied where the application is not fully and properly completed and signed or where it is determined that the organization has violated any provision of this chapter or any rule or regulation pertaining to the use of buildings and grounds which may be adopted by Council from time to time.
The applicant for the use of any portion of the Borough's buildings and grounds agrees to indemnify and forever save harmless the Borough for all loss, liability, costs, expenses, claims, damages and demands of every kind or nature whatsoever, both at law and in equity, including personal injury, death and property damage, and such applicant agrees, upon demand of the Borough, to pay for, or to reimburse the Borough for, any expense of any kind arising from damage to Borough property caused by the applicant or by any person or persons attending any function conducted on Borough property by the applicant pursuant to the application.
A. 
The use of any part or parts of the Borough's buildings and grounds shall be restricted to the purpose for which the use was permitted. The Borough reserves the right to restrict and to supervise the use of the buildings and grounds so as to carry into effect the provisions and intent of this chapter.
B. 
Persons using Borough buildings and grounds pursuant to an application for use must confine themselves to the rooms and corridors or grounds assigned to their use.
Any applicant having the use of any part or parts of the Borough's buildings and grounds shall be required to furnish police at the applicant's own expense if, in the judgment of Council, such protection is desirable. The police selected by the applicant shall be subject to the approval of the Chief of Police of the Borough.
The possession or use of intoxicating beverages or liquor anywhere in or on the premises of any Borough property is prohibited unless approval to possess or use intoxicating beverages or liquor is granted by Council.
No food or beverages are to be sold or distributed unless approval therefor is granted by Council.
Disorderly conduct of any kind is prohibited and is punishable by ejection from the building and/or grounds.
The Borough's buildings and grounds must be vacated at the time designated by Council when the application is approved.
Council reserves the right to request the applicant to furnish and to receive from the applicant a certificate of public liability or other insurance in such amounts as may be deemed advisable by Council prior to the time of use by the applicant of the Borough's buildings and grounds.
Whoever violates or fails to comply with any of the provisions of this chapter shall be fined not less than $100 nor more than $1,000 for each offense. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
