The Parkside Wood Lot along Park Valley Road abutting the Brookhaven
property line, Ridley Creek and the property lines along East Chelton
Road is designated as a park.
Any group of five or more persons wishing to use a park for
recreation or social purposes or to conduct a rally or other gathering
of individuals shall first obtain a permit for use of a park by completing
an application for a permit for use of a park and mailing the application
to or delivering the application to the Borough Secretary at least
10 days prior to the date on which the applicant desires to use the
park. The application shall be accompanied by payment of an application
fee of $15, which fee shall be paid to the Borough Secretary simultaneously
with submission of the application for the permit for use of a park.
Upon receipt of a completed application for a permit for use of a park and the application fee required by §
126-2 above, the Chairman of the Recreation Committee or the person designated by the Recreation Committee shall issue a permit for use of a park within six days and mail or deliver the permit to the applicant on that day or the following day.
The Parkside Elementary School Field is designated as a recreation
center.
A recreation center shall be used only for the holding of an
athletic contest or sporting event.
Any person or persons desiring to use a recreation center to
conduct any type of athletic contest or sporting event of any kind
shall first obtain a permit for use of a recreation center by completing
an application for a permit for use of a recreation center and mailing
or delivering the application to the Borough Secretary at least 45
days prior to the date on which the applicant desires to use the recreation
center. Simultaneously with submission of the application, the applicant
shall also pay the application fee of $75 and shall provide to the
Borough Secretary proof that the person or persons desiring to use
a recreation center to conduct an athletic contest or sporting event
of any kind have obtained public liability insurance in an amount
not less than $100,000 which provides coverage for any injury sustained
by any person or persons while participating in the sporting event
or athletic contest.
Upon receipt by the Borough Secretary of a completed application for a permit for use of a recreation center, the application fee and proof of public liability insurance as set forth in §
126-6 above, the Chairman of the Recreation Committee or such other person as designated by the Recreation Committee shall review the application and either issue the requested permit or deny the request for issuance of the permit within 40 days of the receipt by the Borough Secretary of the completed application, application fee and proof of public liability insurance. On the next day following the issuance or denial of the permit, the Borough Secretary shall mail to or deliver to the applicant the required permit or a letter advising the applicant that the request for a permit has been denied.
In determining whether to issue a permit for use of a recreation
center, the Chairman of the Recreation Committee shall not issue the
requested permit if the use by the applicant would be during a period
of time when another applicant has previously been granted a permit
for use of a recreation center; the requested use is to begin earlier
than 8:00 a.m. or to cease later than 10:00 p.m.; and/or the requested
use is likely to result in damage to the recreation center.
The areas of East Elbon Road and the foot of East Forestview
Road which surround the Parkside Elementary School Field, but not
including the Parkside Elementary School Field, are designated as
a playground.
A playground shall be used only for the purpose of playing basketball
within the fence surrounding the basketball court or for the purpose
of using the swings and other recreational equipment provided in the
playground. No permit shall be required for use of a playground.
The regulations set forth below governing the use of parks,
playgrounds and recreational centers within the Borough of Parkside
are hereby adopted:
A. No person shall sell, use, possess or transport any drugs, paraphernalia,
alcoholic beverage and/or intoxicating liquor within the limits of
any park or playground.
B. No person shall gamble in any form.
C. No person shall wash, clean, polish or repair any vehicle or any
other article or item of personal property.
D. No person shall ignite, kindle or drop any fire of any kind at any
time except when authorized by the Parkside Borough Council.
E. No person shall park or operate any motorized vehicle of any kind,
including but not limited to a truck, bus, car, motorcycle, minibike
or all-terrain vehicle, except when authorized by the Parkside Borough
Council.
F. No person shall indulge in any threatening, abusive, insulting or
indecent language or commit any obscene, indecent or disorderly act
or commit any nuisance.
G. No person shall conduct or participate in any games, athletic activities,
sports, etc., except in designated areas, and such activities are
subject to such rules and regulations prescribed by the Parkside Borough
Council.
H. No person shall ride or lead or graze any horse or pony except by
permission. No person shall allow any dog for which he/she is the
owner or possessor to be at large at any time.
I. No person shall disturb, annoy, strike, injure or kill any animal
or bird.
J. No person shall cut, break, injure, mutilate, remove or deface the
trees, shrubs, plants, turf, buildings, structures, signs, placards,
streams, fountains, springs or any other park, playground or recreation
center property, including sand, stones, clays or minerals.
K. No person shall possess any firearms, knives, air guns, BB guns,
slingshots or any other type of weapons.
L. No person shall erect or maintain or distribute any signs, advertisements,
circulars or other printed matter without permission of Parkside Borough
Council and/or the Recreation Committee of the Borough of Parkside.
M. No person shall collect or solicit any funds or distribute any literature
without the permission of Parkside Borough Council and/or the Recreation
Committee of the Borough of Parkside.
N. No person shall sell or offer for sale any articles of any kind or
any food except when authorized by Parkside Borough Council or the
Recreation Committee of the Borough of Parkside.
O. No person shall participate in group activities other than normal
park activities. No swimming or wading is allowed.
P. No camping, hunting or trapping is allowed without specific permission
from Parkside Borough Council and/or the Recreation Committee of the
Borough of Parkside.
Q. No person shall bring into or deposit any trash, refuse, earth, building
material or similar material into any park, playground or recreation
center.
R. No person shall deposit any refuse incidental to the property and
authorized use of the parks, playgrounds and recreation centers except
in containers provided for the purpose.
S. No person shall golf at any time.
T. No person shall expose themselves, excrete or urinate at any time
in any park, recreation center or playground.
U. No person shall conduct or participate in any games, athletic activities,
sports, group activities, etc., except in designated areas and without
first obtaining a permit from the Parkside Recreation Committee Chairman
or a designated person, at a fee to be determined by the Parkside
Borough Council.
V. No person or persons shall use any park or playground before 8:00
a.m. or after 8:00 p.m. No person shall use any recreation center
before 8:00 a.m. or after 10:00 p.m.
W. The Parkside Borough Council and/or the Recreation Committee of the
Borough of Parkside may, by resolution, adopt additional regulations
governing the use of the parks, playgrounds and recreation centers
and impose such fees therefor as they deem appropriate.
Whoever violates any regulation set forth in this chapter or
any provision of any rule or regulation adopted by the Parkside Borough
Council or Recreation Committee of the Borough of Parkside, pursuant
to the authority granted by law, shall be fined not more than $1,000,
and costs, and in default thereof, shall be imprisoned for not more
than 30 days.
