No person shall engage in the business of selling Christmas trees in the Village of Fox Crossing without a permit obtained from the Village Clerk and payment of the permit fee. The permit shall in no way be construed to affect existing or future zoning or land use.
Any person requiring a Christmas tree sales permit shall make application, in writing, on a form provided by the Village Clerk prior to any sales of Christmas trees within the Village of Fox Crossing. The application shall contain the names and addresses of the seller(s) and the dates and location of the proposed sale, along with information pertinent to the granting of the permit. The seller agrees to conform to all requirements outlined in the Village of Fox Crossing Municipal Code, including Chapter 287, Nuisances, and this chapter.
Fees for selling Christmas trees are set forth in the Village Fee Schedule, reference this Code section, and shall be required at the time of application. Permits shall be issued for a period of 60 days. No permit may be granted or issued to any applicant or for any premises upon which taxes or assessments or other financial claims of the Village of Fox Crossing are delinquent or unpaid.
Any person issued a permit under this chapter to sell Christmas trees, wreaths and the like shall clean up the lot at which the trees are sold in a manner satisfactory to the Village of Fox Crossing Community Development Department within two weeks after December 25 of each year.
All applicants for a permit for a Christmas tree lot must submit a site plan complying with setbacks, parking, where trees will be placed and other requirements as deemed necessary by the Community Development Department.
Failure to obtain a Christmas tree permit and comply with this chapter will result in a penalty set forth in Chapter A450, Fines and Penalties, reference this Code section. Should the Village be required to clean up the lot, a fine will be charged to the permittee.
