The rights, obligations and duties of appointed officials shall be as follows.
The Building Official of the Village of Fox Crossing shall enforce the building regulations, Building Code, Electrical Code, Plumbing Code,[1] Chapter 407, Housing Standards, and all ordinances or regulations pertaining to building, housing, or related subjects in the Village of Fox Crossing. This position shall supersede the former position of the Building Official, Village of Fox Crossing. The Village Board of the Village of Fox Crossing shall authorize and appoint deputies and assistants as deemed necessary to assist the Building Official.

The Village Fire Chief shall have the rights, duties and obligations as specified in the Fire Prevention Code for the Village of Fox Crossing. (See Chapter 218.)
A. 
The Village Board has established a Fire Department and a Police and Fire Commission.
B. 
A commission created under this section is subject to the provisions of § 62.13(2) to (5) and (7) to (12), Wis. Stats., to the extent that the provisions apply to second and third class cities. Excluded are the provisions of § 62.13(6) (Optional powers of board). This section does not grant to the Police and Fire Commission powers greater than those bestowed upon it statutorily. In applying § 62.13, Wis. Stats., under this section, the Village President has the powers and duties specified for a mayor, the Village Board has the powers and duties specified for a common council and the Village has the powers and duties specified for a city.
C. 
The Police and Fire Commission pursuant to § 62.13(3), Wis. Stats., shall appoint the Fire Chief, who shall hold office during good behavior, subject to suspension or removal by the Commission for cause.
D. 
The Fire Chief and Police and Fire Commission shall establish entry-level and promotional procedures for full-time fire officer and firefighter candidates. These procedures shall become a part of the Fire Department Policy Manual and Standard Operating Guidelines. Nothing in this subsection shall be construed as the Village Board's relinquishment to organize and supervise the Fire Department and to prescribe rules and regulations for its control and management.
E. 
The Fire Chief shall develop operational and administrative policies and procedures based on contemporary fire organizational practices. All employees shall receive regular guidance and training relative to organizational goals, objectives, mission statements, policies, procedures, and contractual agreements.

The Street Superintendent shall have specific duties and obligations specified by the Village Board. The general duty of the Street Superintendent shall be to oversee and check on the maintenance and repair of buildings, structures, roads, alleys and all other property owned and maintained by the Village except for Village parks maintained by the Park Commission.

These procedures shall become a part of the Police Department Policy Manual. Nothing in this subsection shall be construed as the Village Board's relinquishment to organize and supervise the Police Department and to prescribe rules and regulations for its control and management.
E. 
The Chief of Police shall develop operational and administrative policies and procedures based on contemporary law enforcement practices. All employees shall receive regular guidance and training relative to organizational goals, objectives, mission statements, policies, procedures, and contractual agreements.

The Village Board hereby grants authority to the attorney/law firm retained by the Village to represent the interests of the Village and directs that such representation shall be conducted under the following policy:
A. 
Whenever a service of notice of litigation is received by the Village Clerk or any other Village official, such matter shall immediately be directed to the Village Attorney for handling. The Village Attorney shall immediately commence the defense of any litigation as deemed necessary for the appropriate representation of the Village.
B. 
Litigation by the Village of Fox Crossing shall not be commenced unless and until such authorization for the commencement of such litigation has been made by the Village Board.
C. 
Following the notice of any new litigation matters, either for or against the Village, such matters shall be directed to the Village Manager by the Village Clerk for placement on the next Village Board meeting agenda for the purpose of having the Village Attorney report the nature and status of the incident to the Village Board. Thereafter, the matter shall be placed on the agenda for Village Board meetings as necessary for current status reports to the Village Board.
D. 
It is the declared policy of the Village of Fox Crossing that the status of legal matters will be regularly reviewed by the Village Board in accordance with the above policy and, except where necessary, such review shall be conducted at regularly scheduled open meetings for the purpose of public information.
