A. 
An area beginning at the easterly corner and extending approximately three hundred thirty (330) feet to the west of the dock and boardwalk shall be used for a promenade and the temporary dockage of transient yachts; this area shall be designated as the "blue area."
B. 
The next section of the boardwalk and dock extending to the west to a point ten, (10) feet east of the boat launching site shall be used for fishing and crabbing; this area shall be designated as the "yellow area."
C. 
The section of the dock and boardwalk west of the launching site shall be used for the loading and unloading of cargo only; this area shall be designated as the "red area."
D. 
The boundaries of the above-designed color areas may be changed by the Township Committee as conditions may require.

A. 
No portion of the public dock may be used as a permanent docking area. The word "permanent" is intended to mean over twenty-four (24) hours.

B. 
The daily fee for use of the boat ramp shall be ten dollars ($10) per day. In the event that a person desires to obtain an annual boat ramp permit, valid for the season, they shall be required to pay a fee of seventy-five dollars ($75) when purchased prior to April 30th. The fee for an annual boat ramp permit after April 30th shall be one hundred dollars ($100) for the season.

C. 
The fees to be charged may be changed by resolution of the Township Committee as conditions may require.

D. 
The daily and annual fee for use of the boat ramp as set forth above in subsection B shall be waived for operators of non-motorized boats who launch their boats from the municipal dock. Non-motorized boats shall include but not be limited to: kayaks; stand up paddle boards; canoes; row boats; non-motorized sail boats and paddle boats.

A. 
The said dock and docking spaces, together with all other properties or lands adjoining said dock and belonging to the township, shall be under the direction and control of the docking master or officer in charge, who shall hold office for such period or periods as the Committee shall hereafter determine.
B. 
Alcoholic beverages prohibited. It shall be unlawful for any person to possess or consume any alcoholic beverages of any kind, nature or description upon the township dock. This section shall not apply to any duly authorized event approved by the Township Committee and when an alcoholic beverage permit has been issued for said function or event.
C. 
No person shall enter the water at the municipal dock from the dock. No person shall swim in the water at the municipal dock or be in the water at the municipal dock without being in a watercraft.

D. 
Commercial businesses launching boats and removing boats at the Municipal Dock for individual customers shall pay the fee as described in Section 43-2B of this chapter, for each individual boat for launching.

The grounds between the public dock and the highway shall be reserved for parking space. Cars with boat trailers shall park in a designated area. No overnight parking shall be permitted without the express consent of the docking master or officer in charge.
No person or persons, partnership or corporation shall use or be permitted to use the public dock for the public hire or rental of rowboats.
No person or persons shall be permitted to change their clothes in the township toilet facilities.
A. 
The use of the public dock and parking area by any organization, group or individuals shall require the prior permission of the Township Committee.
B. 
Hours of use of municipal dock. The hours of use of the dock may be changed by resolution of the Township Committee as conditions may require.

Hours of use of Municipal Dock:
April 1 to September 30:
The dock shall be open from 5:00 a.m. to 11:00 p.m.
October 1 to March 31:
The dock shall be open from 7:00 a.m. to 9:00 p.m.
C. 
The hours as stated in Subsection B. shall be set and based on the need and weather conditions, by the Recreation Director. Hours of Dock Masters shall be set by the Recreation Director based on need and weather conditions.

A. 
Individuals desiring to use the public dock for fishing or crabbing purposes shall be required to pay a fee of two dollars ($2) per day. In the event that individuals desire a seasonal permit to use said facilities for crabbing or fishing then a fee of eight dollars ($8) per season shall be paid prior to April 30th, or a fee of sixteen dollars ($16) per season if applied for thereafter.

B. 
The fees referenced at Subsection A above shall not apply to individuals seventeen (17) years of age or under and residents sixty-five (65) years of age or older shall apply for and receive a permit but shall not be required to pay a fee therefor.

Any person or persons found guilty of violating this ordinance or any section thereof shall, upon conviction, be subject to a fine not exceeding five hundred dollars ($500) or imprisonment for a term not exceeding ninety (90) days, or both. Said fine shall be payable to the Township Treasurer of the Township of Barnegat.
