It shall be a violation of this section for any individual to use the public trash receptacles located on the Beach, Sunset Lake, Public Properties and Grounds, any public areas for anything other than pedestrian generated trash, specifically but not limited to household or commercially generated trash. This section shall be enforced by the Commissioner of Public Works or her/his designee, the Code Enforcement Officer of the borough, the Police Department or any citizen or resident of the borough.
Hazardous substances including, but not limited to, gasoline, kerosene, antifreeze, oil, automobile batteries, chemical pesticides, oil based paint and paint thinner shall not be accepted for pick up.
The borough reserves the right to reject for pick up other articles or materials not specifically described herein or if amounts of said materials or items, such as carpet padding, is deemed to be excessive upon notice to the owner, occupant or proprietor by the borough, it shall be their responsibility to arrange for removal.
Any person, firm, association or corporation violating any provisions, regulations, sections or subsections of this ordinance shall upon conviction by the Municipal Court of the Borough of Wildwood Crest, be subject to a fine of not less than $100 or not more than $1,250 for the first offense or imprisonment in the county jail for not more than 10 days, or community service assisting Department of Public Works. A repetition of any violations shall be deemed a new offense subject to penalties as contained herein. A portion of the fines and penalties collected in accordance with this section can be utilized for the purchase of additional public solid waste/recyclable containers or receptacles upon resolution approved by the governing body.
