A. Definitions. As used in this section, the following terms shall have
the meanings indicated:
IN-SEASON
The predominant season in which a sport is typically played.
Soccer's predominant season is the fall; baseball's predominant seasons
are the spring and summer; lacrosse's predominant season is the spring;
and field hockey's predominant season is the fall.
IN-TOWN TRAVEL TEAM
Nonprofit organizations authorized and/or recognized by the
Borough as those teams not managed, directed or organized by the Borough
of North Caldwell Recreation Department whose participants are comprised
of at least 75% of residents from a West Essex Community.
OFF-SEASON
Any season in which a sport is played that is not identified
as the sport's predominant season.
OUTSIDE ORGANIZATION(S)
In cases when fields are not used by the Recreation Department
or designated Borough sports organizations, nonprofit organizations,
groups and club teams (must provide documentation of nonprofit status)
will receive next preference followed by for-profit organizations.

OUT-OF-TOWN TRAVEL TEAM
Volunteer-associated teams who are not directly affiliated
with the West Essex Community or whose participants are not comprised
of at least 75% of residents from a West Essex Community.
B. Whenever any person, group, association or organization desires to
reserve any field, park, public land or other Borough facilities for
a particular purpose, such as games, sports practices, picnics, parties
or theatrical or entertainment performances, or any other activity
or event, a representative of said person, group, association or organization
shall first obtain a permit from the Borough Administrator or their
designee.
C. The Borough Administrator or their designee, upon approval of the
Recreation Committee of the Borough Council, hereinafter referred
to as the "Recreation Committee," shall grant the permit if it appears
that the person, group, association or organization meets all of the
conditions contained herein and contained in an application form to
be hereinafter provided by the Mayor and Council. The application
may also contain a requirement for an indemnity bond or insurance
policy to protect the Borough from any liability of any kind or character
and to protect Borough property from damage.
D. In scheduling and prioritizing any use of Borough facilities or fields,
the Recreation Committee shall have the discretion to give priority
to all in-season sports, activities or events over all off-season
sports, activities or events. The Recreation Committee, at its own
discretion, may limit or deny any use of all Borough facilities or
fields for out-of-town travel teams. In evaluating and prioritizing
any facility or field request, the Recreation Committee of the Borough
Council shall at a minimum consider the following factors, which may
not be exclusive, and shall include such additional guidelines as
may be established by the Recreation Committee:
(1) The seasonal nature of the sport to be played or event to be held.
(2) The number of North Caldwell participants to be served;
(3) The ages of the participants in order to assure the appropriateness
of the field or facility requested or assigned by the Recreation Committee;
and
(4) The condition of the Borough's field and facilities and the potential
impact of the activity on the condition of the field or facility.
E. Fees for the use of Borough facilities may be charged pursuant to
fee ordinances which may be adopted by the Borough. Fees for the use
of Borough fields will be charged as follows:

(1) Liberty Turf Field Use Fees.
(a)
All Borough Recreation Department sports, activities or events
shall not incur a field use fee regardless of sport, season, or field.
(b)
All in-town travel teams will pay a use fee as follows:

In-season use fees shall be $25 per player per season;

Off-season use fees shall be $35 for two hours of permitted
use. An additional $35 is required for an additional two hours of
permitted use.
(c) Outside
organizations will pay an hourly use fee as follows:

season regardless of season.

No person shall picnic or lunch in any place in the park or
public land other than those areas designated for that purpose. Attendants
shall have the authority to regulate the activities in such areas
when necessary to prevent congestion and to secure the maximum use
for the comfort and convenience of all.
No person shall use any portion of the picnic areas or any of
the buildings or structures thereon for the purpose of holding picnics
to the exclusion of other persons, nor shall any person use such areas
and facilities for an unreasonable time. Any person using the picnic
areas designated above shall not leave a picnic area before the fire
is completely extinguished and before all trash in the nature of boxes,
papers, cans, bottles, garbage and other refuse is placed in the disposal
receptacles, where provided. If no such trash receptacles are available,
then refuse and trash shall be carried away from the park area by
the picnicker to be properly disposed of elsewhere.
No person shall willfully mark, deface, disfigure, injure, tamper
with or displace or remove any building, bridges, tables, benches,
fireplaces, railings, paving or paving material, water lines or other
public utilities or parts or appurtenances thereof, signs, notices
or placards, whether temporary or permanent, monuments, stakes, posts
or other boundary markers or other structures or equipment, facilities
or park or public land property or appurtenances whatsoever, either
real or personal.
Any person using rest rooms and/or washrooms contained on any
park or public land area shall cooperate in maintaining the rest rooms
and/or washrooms in a neat and sanitary condition. No person over
the age of five years shall use the rest rooms and washrooms designated
for the opposite sex.
No person while in the park or public land areas shall dress
or undress except in such bathing houses or structures as may be provided
for that purpose.
It shall be unlawful to bring any animals into the park or public
land, except dogs or pets on a leash not more than six feet in length.

It shall be unlawful for any person, other than those officially
designated or authorized by the Borough of North Caldwell, to vend,
sell, barter, peddle or offer for sale any commodity, article or service
within any Borough park or public land, or to be provided within any
borough park or public land. It shall also be unlawful for any person
to place any station or stand, cart or vehicle for transportation,
sale or display of any such article, thing or service within the borough
parks or public lands.
It shall be unlawful for any person to paste, glue, tack or
otherwise post any sign, plaque or advertisement or inscription whatsoever,
nor shall any person erect, or cause to be erected, any sign whatsoever
on any public land or highway or roads adjacent to said park or public
land or playground, or highway or roads adjacent to said park or playground
area, unless otherwise authorized by the Borough of North Caldwell.
It shall be unlawful to engage in special activities, including
but not limited to golf practice, archery and other games, at locations
other than specifically designated for such activities.
It shall be unlawful to conduct any fireworks display in the
park or public land area, unless a permit is first obtained from the
Chief of Police in the Borough of North Caldwell.

It shall be unlawful to engage in or conduct any camping activities
in the park or public land area of any kind whatsoever, unless a permit
is first obtained from the Recreation Committee of the Borough Council
in charge of parks or playgrounds.

Unless otherwise provided by law:
A. Any person violating any of the provisions of this chapter shall, upon conviction thereof, be punished for each offense by a penalty as stated in Chapter
1, Article
II General Penalty, Section
1-5 et seq. The Municipal Court Judge before whom any person is convicted of violating this chapter shall have the power to impose any fine or term of imprisonment not exceeding the maximum fixed in this chapter.
B. In default of the payment of any fine imposed hereunder, any person
convicted of any violation may, in the discretion of the Municipal
Court Judge by whom he was convicted, be imprisoned in the County
Jail or place of detention provided by the municipality for any term
not exceeding 90 days.

Any person violating any of the provisions of this chapter shall, upon conviction thereof, be punished for each offense by a penalty as stated in Chapter
1, Article
II, General Penalty, §
1-5 et seq. The Department of Recreation, its agents and park attendants shall, in connection with their duties imposed by law, diligently enforce the provisions of this section and all other applicable ordinances.
