No driveway, curb, sidewalk, mailbox or any other structure shall be installed or placed in the legal right-of-way of any Township owned street unless it is in compliance with the provisions of this chapter, any outside regulatory authority having jurisdiction, as applicable, and any other ordinances or regulations of the Township of Limerick not inconsistent herewith, including but not limited to Chapter 155 "Subdivision and Land Development."
All safety protection methods, devices, and procedures shall be in
conformance with PA DOT Publication 213, Temporary Traffic Control
Guidelines current edition and will be furnished and maintained solely
by the applicant.
Applicant shall maintain policies of liability insurance in full
force effective from the date the permit is issued until date the
permit is closed out.
Construction shall not commence until such time as all permits and
approvals for work has been obtained, a PA One Call has been placed
and cleared, and a preconstruction conference has been held.
The grade to which every driveway, curb, sidewalk, or other structure
shall be hereafter laid, constructed, or repaired, other than that
established in an approved land development plan, shall be that fixed
and designated by the Administrator.
The space between the back side of the curb and the street side of
the concrete edge of the sidewalk shall be four feet zero inches,
and the sidewalk concrete width shall be five feet zero inches in
all new developments or street construction. In existing developed
sections of the Township and where sidewalks have been constructed
prior to the date of this article, existing conditions shall be taken
into consideration by the Administrator in applying the width and
location regulations.
No open gutters for conveying rainwater or drainage of any kind will
be permitted to run over the top of the sidewalk or curb. All underground
stormwater conduit shall be a pipe material type permitted in the
specifications and constructed under the sidewalk and through the
curb to the gutter.
All openings or excavations of streets, excepting drill holes, shall,
before completion, be cut with a power saw and not with an air jackhammer
or similar device.
Any person opening or excavating any street shall, upon completion
of the project and after notification of the Township, immediately
and completely backfill such openings or excavations, mechanically
tamping the same so as to prevent any settling thereof, and shall
restore the surface to the same condition as it was prior to the making
of such opening or excavation; and prior to the expiration of the
permit, shall remove from the site of work all debris, tools and equipment.
All backfilling and restoration shall be done in strict conformance
with the detailed sketches for backfilling and restoration in accordance
with the specifications.
Temporary restoration. For construction between October 1 and April
1, the trench shall be backfilled in accordance with the specifications
for permanent restoration. The final step shall be a temporary application
of bituminous stockpile mix to bring the trench to street grade. Periodically,
inspection shall be made to maintain the trench in a condition satisfactory
to the Administrator or Engineer. On or before May 31 following the
date the street cut was first made, the permittee shall permanently
restore the cut.
Permanent restoration and backfilling of any opening and/or excavations
within an existing street shall be in accordance with the specifications
and following:
Newly constructed or repaved streets. No street opening or excavation
shall be permitted and no permit pursuant to this chapter shall be
granted for any street opening or excavation of any newly paved street
for any purpose whatsoever within three years from the date of completion
of the paving, except for emergency repairs or for services to a recorded
land development plan, and then only with special permission having
been granted by the governing body, upon written recommendation by
the Engineer.
If any opening or excavation shall take place a newly constructed
street or a street repaved within three years prior to the date of
issuance of said permit, the entire street covered by the permit issued
at the location where the work is to be done, at the discretion of
the governing body, shall be resurfaced with paving materials in accordance
with the specifications.
If any opening or excavation shall take place for any purpose whatsoever,
including emergency, within the first year from the date of completion
of surfacing or resurfacing of any street, then the applicant shall
pay to the Township a fee as established in the fee schedule set by
resolution of the governing body for the use by the Township for the
repair and restoration of said street. Said street opening of Newly
paved street fee shall be in addition to all costs to applicant for
the backfilling and restoration of said street opening or excavation,
which shall be the sole responsibility of the person making such street
opening or excavation and in addition to resurfacing the entire street.
The governing body may require a property owner of Limerick Township
to install in the sidewalks and curb within the legal right-of-way
of the street abutting their respective property at the sole expense
of the property owner after receiving written notice from the Township.
The layout and construction shall be in conformance with the provisions
of this chapter and approved by the Administrator or Engineer.
It shall be the duty of the owners of the land abutting upon any
curbs or sidewalks to keep them in such repair and condition that
they may not be or become dangerous to the welfare and safety of the
traveling public. Nothing herein contained shall be construed to place
the responsibility of determining when sidewalks may become dangerous
to the welfare and safety of the traveling public upon the Township.
At all times such responsibility shall be solely upon the property
owner whose land abuts the curb or sidewalk.
Driveway pipes. Maintenance of driveway pipes located within the
legal right-of-way of any Township Street shall be the responsibility
of property owners. If it is determined by the Administrator that
a driveway pipe needs to be replaced, it is the responsibility of
the property owner who owns the driveway to replace the driveway pipe
upon notice sent by the Township. The property owner shall replace
the driveway pipe in accordance with the Specifications and provisions
of this chapter.
Trimming of trees. Trimming of trees, plant, shrub, or other vegetation
located within or overhanging in the legal right-of-way of the street
shall be the responsibility of the property owner. The height of clearance
in paved roadway shall be 16 feet above the roadway. The height of
clearance outside the paved roadway shall be 10 feet above ground
or sidewalk.
Structures in the right-of-way. Fences, walls, landscaping, decorative
rocks, basketball hoops or any other sport related structures, or
other structures shall not be permitted in the legal right-of-way
of the Township street, except mailboxes in accordance with the provisions
of this chapter and street trees in accordance with an approved land
development plan.
Structures in the right-of-way of a Township Street are at the property
owner's risk. To alleviate the possibility of damage due to snow
plowing and vehicular traffic, any mailboxes installed after the effective
date of this chapter shall comply with the following requirements:
On paved streets with no curb, the face of the box shall be offset
the width of the shoulder plus eight inches from the cartway, and
if there is no shoulder it shall be 12 inches from the cartway;
Mailboxes shall be constructed of sheet metal, plastic or similar
weight materials, with weight not to exceed 11 pounds. Newspaper boxes
may be mounted below the mailbox on the side of the support or on
its own post. No more than two mailboxes can be mounted on a support
structure unless the configuration has met U.S. Department of Transportation
crash test;
A single four-inch-by-four-inch square post or four-inch diameter
wooden post, or light gauge pipe with strength no greater than two-inch
standard steel pipe shall be imbedded between 24 inches and 36 inches
in the ground. The mailbox and its support will be considered hazardous
to motorist when the support exceed the described structural limitations.
