[Adopted by Ord. No. 974-93 (Sec. 25-6 of the 1997 Revised General Ordinances)]
Pursuant to N.J.S.A. 40A:14-26, N.J.S.A. 40A:14-156.1 et seq., and N.J.S.A. 40A:14-146.8 et seq., there is hereby established a Mutual Aid Agreement with all other municipalities in Cape May County, New Jersey, who adopt a reciprocal ordinance to provide mutual police and/or mutual fire aid in case of emergency. This agreement shall apply whenever the City of Cape May may have an emergency within its boundaries requiring additional police assistance or additional fire assistance to protect life and property or to assist in suppressing a riot or disorder, whenever any other municipality in this county which has enacted a reciprocal ordinance may experience a similar emergency requiring additional police assistance and/or additional fire assistance.
Pursuant to N.J.S.A. 40A:14-146.10, a special law enforcement officer under the supervision and direction of a full-time Chief of Police is hereby authorized to perform his duties in any other municipality in Cape May County which has enacted a reciprocal ordinance to provide mutual police aid and/or mutual fire aid in case of emergency.
The Chief of Police of the City of Cape May is hereby authorized to request assistance from the Police Chief of the Police Department of any other municipality within Cape May County to provide aid during and after any police emergency, provided that such other municipality has enacted an ordinance which is reciprocal to the within ordinance. The Fire Chief of the City of Cape May is hereby authorized to request assistance from the Fire Chief of any other municipality within Cape May County to provide aid during or after any fire emergency, provided that such other municipality has enacted an ordinance which is reciprocal to the within ordinance.
The Chief of Police of the City of Cape May and/or the Fire Chief of the City of Cape May shall provide the assistance which is so requested, provided such other municipality has enacted a reciprocal ordinance to the within ordinance, to any other municipality or municipalities in Cape May County, making a valid request to supply such personnel and equipment as required to the extent possible without endangering persons or property within the City of Cape May. The members of the Police Department of the City of Cape May and/or members of the Cape May Volunteer Fire Company, supplying such aid, shall have the same powers, authority, rights and immunities of the members of the Police Department and/or Fire Department of the municipality to which such assistance is rendered.
The City of Cape May shall, upon providing police assistance and/or fire assistance to such other municipality which has enacted a reciprocal ordinance to the within ordinance, assume the cost and expense of providing its personnel and equipment to the requesting municipality, except in such instances when the requesting municipality shall receive state or federal aid by way of reimbursement. In the case that the requesting municipality shall receive state or federal aid, the cost incurred in supplying such aid to such other municipality shall be submitted, by voucher, to the municipality to whom such assistance was rendered.
Members of the Police Department of the City of Cape May and/or members of the Cape May Volunteer Fire Company, suffering injury, or their legal representatives if death results while rendering assistance in another municipality, shall be entitled to all of the benefits which they would have realized if their injury or death had occurred in the performance of normal duties rendered within the City of Cape May.
