This chapter is for the purpose of regulating all games of chance held, operated or conducted within the City, pursuant to the Acts of the Legislature of the State of New Jersey, known as the "Bingo Licensing Law"[1] and the "Raffles Licensing Law,"[2] and in accordance with the rules and regulations issued or to be promulgated by the Legalized Games of Chance Control Commission in the Department of State of the State of New Jersey. All applications, licenses and proceedings in connection therewith shall be subject to the provisions of the Acts and the rules and regulations, and any laws, rules and regulations hereafter enacted; and shall be further subject to the provisions of this chapter.

No licensee authorized by law shall hold, operate or conduct any game of chance at the place where the game of chance is being conducted under any license except between the hours of 1:00 p.m. and 11:00 p.m.
The playing of bingo games on Sunday is hereby permitted in the City commencing not sooner than 7:00 p.m.
No license to conduct a game of chance as authorized by law shall be issued to any organization not having a bona fide situs established in good faith within the State of New Jersey and actively engaged in serving one or more of the authorized purposes as defined by the rules and regulations of the Legalized Games of Chance Control Commission.
No game of chance shall be conducted under any license at any time during which a general, municipal, primary, special or Board of Education election is being held, while the polls are open for voting at such election.

Pursuant to N.J.A.C. 13:47-4.10, all qualified organizations are exempt from the payment of a municipal licensing fee under this chapter. For purposes of this section, qualified organizations are defined pursuant to N.J.A.C. 13:47-1.1 as follows:
A. 
Qualified organization means a bona fide organization or association of veterans, religious congregation, religious organization, charitable organization, educational organization, fraternal organization, civic and service club, officially recognized volunteer fire company, officially recognized first aid squad, and officially recognized rescue squad, and senior citizens association or club, which:
(1) 
Is organized as a nonprofit or religious organization and is authorized by its certificate or articles of incorporation, bylaws or other written authority to support one of the authorized purposes;
(2) 
Appoints the Executive Officer of the Control Commission as agent for the service of process; and
(3) 
Is constituted of not fewer than five individuals.
