This chapter shall be called the "Driveway Installation Law of the Village of Waterford."
Prior to the construction of any driveway where such driveway leads to a road owned or to be dedicated to the Village of Waterford, an application for a driveway permit must be made to the Zoning Commissioner. The fee for such permit shall be determined by the Village Board of Trustees by resolution from time to time.
All applications for construction of driveways shall be referred to the Planning Board. No permit shall be issued until the application is approved by the Planning Board. The Planning Board may grant or deny the application and determine what conditions, if any, should be imposed on the construction of the driveway if the permit is granted.
If the Planning Board approves the issuance of the permit, the Zoning Inspector shall issue the permit to the applicant. Such permit shall incorporate any conditions imposed by the Planning Board.
A. 
In reviewing the application and in granting or denying the permit the Planning Board shall apply the following minimum standards:
(1) 
There must be adequate sight distance for vehicles entering and exiting the driveway;
(2) 
The curb cut for the driveway may not cause a net loss of parking spaces on the street where the curb cut is located;
(3) 
There may be no interference with the use of the public sidewalk as a result of the construction of the driveway;
(4) 
With respect to the parking of vehicles, all requirements of the Village of Waterford Zoning Law[1] for off-street parking, as set out in § 205-26 of the Zoning Law of the Village of Waterford, must be met.

B. 
In addition, the Planning Board may take into account any way in which the proposed driveway will negatively affect the use of Village streets and the effect of the proposed driveway on the health, safety and welfare of residents of the Village of Waterford.
Any driveway constructed in the Village shall comply with the requirements of § 102-5 and any other conditions imposed by the Planning Board. Any driveway for which no permit is issued, which is constructed in violation of this chapter or conditions imposed by the Planning Board, shall be removed at the expense of the owner of the property on which it is located.
