It is the purpose of this chapter to implement Article 8 of the State Environmental Conservation Law, hereinafter referred to as the "Act," in the Village of Waterford.
The Board of Trustees of the Village of Waterford concurs in the findings and declarations of the Legislature of the State of New York as expressed in § 8-0103 of the Act, and the Board therefore declares its intent that to the fullest extent possible the policies, statutes, regulations and rulings of the Village of Waterford and each of its separate officers, boards and commissions shall be interpreted and administered in accordance with the policies set forth in the Act and that the village itself shall conduct its own affairs with an awareness that the village has an obligation to protect the environment of the village for the use and enjoyment of this and future generations.
For the purpose of this chapter, the following terms shall have the indicated meanings:
ACTION
The same meaning as set forth in Subdivisions 4 and 5 of § 8-0105 of the Act.
AGENCY
Any officer, board, district or commission of the Village of Waterford which under any provision of state, general, special or local law or regulation regulates the activities of individuals, corporations and public agencies which are found to affect the quality of the environment of the Village of Waterford.
ENVIRONMENT, ENVIRONMENTAL IMPACT STATEMENT AND DRAFT ENVIRONMENTAL IMPACT STATEMENT
The same meanings as respectively are set forth in Subdivisions 6, 7 and 8 of § 8-0105 of the Act.
A. 
Whenever the Village of Waterford or any of its agencies as hereinabove defined shall propose any action or propose to approve any action which may have a significant effect on the environment of the Village of Waterford there shall be prepared or caused to be prepared by contract or otherwise an environmental impact statement, which environmental impact statement shall be prepared, filed, discussed, subjected to public comment and acted upon in conformity with the procedure set forth in § 8-0109 of the Act and the official regulations of the Commissioner of the State Department of Environmental Conservation, hereinafter referred to as the "regulations of the Commissioner."
B. 
In determining whether a proposed action may have a significant effect on the environment of the Village of Waterford, the village and any of its agencies shall have reference to the regulations of the Commissioner as codified in Part 617 of the New York State Code of Rules and Regulations, as the same may be from time to time amended and clarified.
Consistent with the mandate of §§ 8-0107 and 8-0111 of the Act, the Village of Waterford and each of its agencies shall attempt to implement the provisions of this chapter and of the Act with a minimum of procedural and administrative delay, avoiding unnecessary duplication of reporting and review requirements by providing where feasible for combined or consolidated proceedings with other state, federal and local governments and their agencies.
Nothing contained herein shall be deemed or construed to impose on the Village of Waterford, its agencies or any individuals, corporations or other public agencies any additional or further requirements beyond those set forth in the Act or in the official regulations of the Commissioner promulgated thereunder.
