As used in this chapter, the following terms shall have the meanings indicated:
SKATEBOARD
A narrow board of wood, plastic, fiberglass or similar material with some roller skate or other types of wheels attached to each end and used for gliding and moving on any hard surfaces, without a mechanism or other device for steering while being used, operated or ridden.
A. 
No persons shall use or operate a skateboard upon any public roadway, sidewalk, village-owned parking lot, village-owned park or other village-owned property within the Village of Waterford.
B. 
No person shall operate a skateboard on any private property within the Village of Waterford without the consent of the owner thereof.
A. 
Upon issuance of a citation for violation of this chapter, the owner of the skateboard or, if the owner is a minor under the age of 18, the aforesaid minor accompanied by his parent or guardian may make application to a Justice of the Town Court of the Town of Waterford for return of his skateboard. If no violation of this chapter is found to have occurred, the skateboard shall be returned to the owner and/or parent or natural guardian.
B. 
If a violation of this chapter is found to have occurred, the following penalties shall apply:
(1) 
For a first violation, the skateboard will be returned to the owner or his or her parent or guardian;
(2) 
For a second violation, a fine of $25 will be imposed and the skateboard shall be returned to the owner or his or her parent or guardian;
(3) 
For a third violation, a fine of $25 shall be imposed and the skateboard shall be returned to the owner or his or her parent or natural guardian; and
(4) 
For a fourth violation, the skateboard shall be confiscated and not returned to the owner.
