The parks of the Borough of Glenolden shall consist of the real property acquired by the Borough by deed dated September 1, 1933, recorded in Deed Book No. 975 at Page 24, and the real property similarly acquired by deed dated May 7, 1934, recorded in Deed Book No. 987 at Page 350, all recorded in the office of the Recorder of Deeds of Delaware County and known generally as "Glenolden Park."
The parks of the Borough of Glenolden and all park property, equipment and facilities may be used only in accordance with the following rules and regulations:
A. 
Park hours. The park is open for use only between the hours of 9:00 a.m. and 9:00 p.m.
B. 
Fireplaces and grills. Fireplaces and grills in the park may be used only by those individuals holding a valid permit issued by the Borough of Glenolden and only between the hours of 9:00 a.m. and 7:30 p.m.
C. 
Tennis courts. Play at Borough tennis courts is limited to one hour per group, weather permitting.
D. 
Ball fields. Ball fields may be used only by those holding a valid permit issued by the Borough of Glenolden.
E. 
Park areas. No motorized vehicles, bicycles, scooters, skates or other similar vehicles or devices are permitted in any park areas.
F. 
Ballplaying. No ballplaying is permitted in any park areas other than on designated ball fields.
G. 
Littering. Littering anywhere in the park is prohibited.
H. 
Alcoholic beverages. The use, consumption or possession of alcoholic beverages anywhere in the park is prohibited.
I. 
Animals. No animals are permitted in the park.
J. 
Vandalism. Vandalism to park land. trees, property or facilities is prohibited.
The Property and Park Committee may post copies of the rules and regulations set forth in § 118-2 or summaries of the same at such places in the park as said Committee shall designate. The failure to post said signs shall not constitute a defense in any prosecution under this article.
Violation of any of the rules or regulations set forth in § 118-2 shall be punishable, upon conviction before a District Justice, by a fine of not less than $25 nor more than $100, and costs of prosecution, and restitution in the case of damage to Borough parks or park property, equipment or facilities and, upon default in payment of the same, by imprisonment for not more than 30 days.
The rules and regulations adopted in this article are deemed reasonable and proper police measures in the opinion of the Property and Park Committee and the Borough Council and are intended to promote peace and order and to protect property, trees and shrubbery and to regulate all uses and activities in the park.

The regulations and prohibitions of this article shall govern, regulate and restrict the conduct of all persons in the public parks and playgrounds of the Borough, including but not limited to all parks (including the gazebo).
A. 
The gazebo may not be used by groups of any size without a permit that has been obtained in advance.
B. 
No groups of 10 or more shall be allowed in any park, except the gazebo, unless a permit has been obtained in advance.
C. 
In addition to permit application fees which may be set from time to time by Borough Council by Resolution, there shall be a two-hundred-fifty-dollar cleanup deposit for residents of Glenolden Borough and a five-hundred-dollar deposit for nonresident applicants paid to the Borough in advance of the issuance of any permit for any park including the gazebo. (The cleanup deposit may, from time to time, be set by Borough Council upon resolution.)
D. 
If by 9:00 a.m. the day after the permitted use of any park there remains any trash or debris not cleaned up to the sole satisfaction of the Borough duly designated park inspector, said cleanup deposit shall be forfeited in full.
E. 
In addition to the above fees, deposits and the like, if any group consists of 10 or more persons, there shall be an additional park guard fee of $15 per hour for the duration of the permitted event. (The park guard fee may, from time to time, be set by Borough Council upon resolution.)
F. 
Any damage caused to the Borough's parks, including the gazebo, shall be the responsibility of the permit applicant and/or the attendees jointly and severally. The Borough is authorized to seek reimbursement from said person(s) plus costs of collection, legal fees and interest from the date of damage.
G. 
All other rules and regulations pertaining to any of the Borough's parks, including the gazebo, shall apply to any permitted events.
H. 
All permit applicants shall provide proof of sufficient insurance coverage as may be required by the Park Committee.
Permits for the use of parks shall be issued by the Borough Secretary (or other Borough designee as established by Resolution by Borough Council) upon written application. A permit shall be issued by the Secretary after an applicant meets the requirements of the Park Committee and provides proof of sufficient liability insurance as determined by the Park Committee.
The Police Department or any authorized agent of the Borough of Glenolden is authorized to enforce this article.
Any person violating any of the provisions of this article, upon conviction thereof before a District Justice, shall be sentenced to pay a fine not in excess of the amount of $600, to be paid for the use of the Borough of Glenolden, with costs of prosecution, or to undergo imprisonment in the county jail for a period of not more than 30 days, or both.
