Wherever the following words and expressions are used in these specifications and regulations, they shall have the meaning as defined below.
CERTIFICATE OF COMPLETENESS
The written approval, issued by the Highway Superintendent, stating that all requirements both for construction and performance have been complied with.
DEAD-END STREETS
Shall be defined to mean an unbroken length of surface running from and including its nearest intersecting street.
DEVELOPMENT or SUBDIVISION
The division of any parcel of land into two or more lots, plots, sites or other divisions of land for immediate or future sale or for building development in such a way as to create one or more new roads or streets or new extensions to existing roads or streets.
DEVELOPMENT OR SUBDIVISION ROADS
The roads or streets created from the subdivision of land into lots, plots, etc.
HIGHWAYS, ROADS or STREETS
The whole strip of land for the use of the traveling public bounded by the property lines on either or both sides.
ITEMS OF CONSTRUCTION
Under these specifications the developer or contractor is required to do all work enumerated under the different items of these regulations and specifications.
LENGTH OF ROADWAY
A length of road shall be defined to mean an unbroken and complete length of regulated surface running from and to and including its intersecting streets, as the case may be.
MATERIALS FOR CONSTRUCTION
Any approved material approved by the Highway Superintendent and conforming to the requirements of the specifications.
NASSAU COUNTY AND TOWN OF HEMPSTEAD SPECIFICATIONS AND STANDARDS
The existing body of directions, requirements, etc., pertaining to any type of construction or regulation, or any item or material or materials for construction relative to or affecting Town of Hempstead methods and practice.
PERFORMANCE BOND
The bond required by the Planning Board of the Town of Hempstead sufficient to cover the full cost of the improvements as mentioned, or as more fully described in Article 16, Section 277, "Approval of plats: additional requisites," of the Town Law, and as required by the Superintendent of Highways of the Town of Hempstead or the Town Board for the acceptance of streets into the Town highway system pursuant to Subdivision (c) of Section 280 of the Town Law.
SPECIFICATIONS
The body of directions, requirements, etc., contained herein, together with all documents of any descriptions and agreements made pertaining to the methods and manner of performing the work mentioned.
STREET SIGNS OR MARKERS
A highway, road or street sign for a particular purpose and place, when and where directed.
TOWN ROAD SYSTEM
All roads, streets, highways, lanes or rights-of-way within the Town of Hempstead (outside of incorporated villages) maintained by the Town Highway Superintendent.
TYPICAL SECTION
An official drawing or plan pertaining to the work and methods relative to roads, highways or streets.
WIDTH OF ROADWAY
Shall be defined to mean the distance as measured from property line to property line within which shall be included the regulation and construction of all appurtenances necessary for a complete regulated road, highway, street or intersection. A road or street shall be inclusive of sidewalks, curbs, catch basins, drains and appurtenances, street signs, markers and street trees.
A. 
A road for approval and/or for acceptance into the Town road system shall be so regulated and/or constructed according to the following specifications:
(1) 
A development or subdivision road or any other street, highway or right-of-way (submitted for approval or acceptance) shall include the full width as shown on the filed subdivision map, or the width or traveled way as determined by the Superintendent of Highways, and shall be regulated and/or constructed according to the Town of Hempstead typical section for the road or roads considered. Any conditions relative to length of regulated surface, other than as stipulated, shall be at the discretion and determination of the Highway Superintendent.
(2) 
A performance bond sufficient to cover the full cost of the proposed improvement, as estimated by the Planning Board, the Superintendent of Highways or the Town Engineer, shall be furnished to the Town by the owner. Such performance bond shall be issued by a bonding or surety company approved by the Town Board and shall also be approved by such Board as to form, sufficiency and manner of execution. If a performance bond covering specific roads or streets has already been filed with the Town in accordance with resolution of the Town Planning Board, and the bond is still in existence, then this provision shall be null and void with respect to said specific roads or streets.
B. 
Construction regulation.
(1) 
Construction and/or regulation of roads for approval shall be constructed and/or regulated under Town of Hempstead highway supervision and inspection and shall be governed according to specifications affecting each item of construction. Materials for construction, catch basins, concrete pipe, casting and fittings, road oil and/or any other material or item used in the road construction and/or regulation shall be according to Nassau County and Town of Hempstead specifications and standards. Under these specifications the developer or builder, or persons applying for (in regard to streets for approval), shall be required to carry out the intent and requirements, etc., contained herein, together with any agreements made (or to be made) by the Highway Superintendent pertaining to the best method of performing the work necessary for an approved Town road.
(2) 
The Town Superintendent of Highways shall issue an official form, stating therein the various items of work or construction to be performed. The contractor or developer shall fill out the required blanks so that proper inspection and approval of the proposed items of work will be recorded and filed. These forms shall be filed by the developer and/or contractor with the Town Superintendent of Highways not later than 10 days before the time of commencement of work within the highway or road area.
C. 
Drainage. Where drainage conditions warrant the construction of catch basins and drains, the developer or contractor shall construct, in a manner so directed, such drains and appurtenances to remedy the condition. Catch basins and drains shall be constructed in accordance with Town specifications for same. The Town Superintendent of Highways shall approve the construction of same when and where needed.
D. 
Street grades. Elevation, grades and alignment pertaining to development streets or other existing streets or highways shall be regulated and graded according to the approved or legal grades as established by the Town Engineer.
E. 
Street intersections.
(1) 
Surface drainage at street intersections where no catch basins exist or where none will be provided for shall be regulated with an open gutter running parallel with the drainage street.
(2) 
The intersecting street shall be cut back and sloped, to this open gutter, a distance of 25 feet for each side, measured from the center line of the drainage street. Where catch basins are provided for at intersections, the crown of the intersections shall be equal. Catch basins when provided for shall be located a distance of 30 feet measured from the center line intersection to the center of the basin.
F. 
Applications for approval.
(1) 
When an applicant or developer shall have completed a road or highway according to the requirements as set forth, he shall prepare same for final inspection. Before final inspection and for approval, the road or highway (for the length of its approval) shall be according to the typical section as contained herein, and in addition, shall be free from all building materials, excavations and any or other obstructions, and its surface shall be smooth and uniform and free from noticeable excavation pits, sumps and holes. After final inspection by the Highway Superintendent or his representative, and if approved, a certificate of completeness shall be issued by him, stating that all requirements, both for construction and performance, have been complied with. A certificate of completeness shall bear the signature of the Town Superintendent of Highways and shall be considered as a certificate of approval. A certificate of approval shall be given to the applicant only upon written agreement by the applicant, to the extent that no obstructions, openings or excavations shall be made after approval, in or upon any of the completed surfaces.
(2) 
Violations, unsatisfactory construction or noncompliance with any of the requirements as set forth, or nonperformance of any agreements, written or otherwise, relative to Town roads for acceptance or approval, shall be reason to consider the performance bond forfeited to the Town. Upon receipt of the proceeds thereof, the Town Superintendent shall remedy any violation or unsatisfactory work to his satisfaction and approval.
G. 
Conclusion. Notwithstanding the foregoing provisions of these specifications, the Town Superintendent of Highways may waive, subject to conditions, the provisions of any or all of the foregoing requirements, in his judgment, for the special circumstances of a particular road or condition, in the interest of public health, safety and general welfare.
All street paving, curbs, gutter slabs, sidewalks and driveway aprons shall be constructed in accordance with specifications for subdivisions as prepared by the Nassau County Department of Public Works and in effect at the time of final approval of the plat. Detailed specifications will be supplied. The general types, thickness and other requirements are as follows:
A. 
Pavement specifications. (Applicable to minor residential streets only. For secondary or feeder streets and major roads, standard specifications of the Nassau County Department of Public Works shall apply.)
(1) 
Bituminous-type pavement.
(a) 
Base.
[1] 
Macadam base of broken stone, penetrated with a bituminous material to a compacted thickness of 4 1/2 inches. Or
[2] 
Broken stone base filled with sand mechanically bonded to a compacted thickness of 4 1/2 inches. Or
[3] 
Concrete base by proportionately mixing by weight one part portland cement, three parts sand and six parts screened gravel or broken stone five inches thick.
(b) 
Top wearing course. Bituminous concrete compacted to a minimum thickness of 1 1/2 inches, with the exception of the concrete base, in which case the compacted thickness shall be a minimum of one inch.
(2) 
Concrete pavements.
(a) 
A six-inch portland cement reinforced concrete pavement mixed proportionately using one part portland cement with two parts washed sand and four parts broken stone aggregate measured separately by weight.
(b) 
Curbs. Curbs shall be 18 inches in depth with five inches extending above the water line and six inches in width at the top expanding to a width of seven inches at the water line and continuing at that width to the bottom. The curb shall be constructed of concrete with a 1:2:4 mix.
(c) 
Gutter slab. A gutter slab of concrete will be required in conjunction with the bituminous-type pavement where the gradient is 0.4% or less, and shall be constructed three feet wide adjacent to the curb and conforming to the concrete paving specifications given above.
(d) 
Sidewalks. Sidewalks shall be four inches thick and at least four feet wide, constructed of one-course concrete with a 1:2:4 mix. Where the sidewalk is laid in driveway entrances, it shall be six inches thick.
(e) 
Driveway aprons. Driveway aprons shall be six inches thick, 10 feet in width at the face of curb and seven feet in width at the property line, with a step in the face of curb of one inch, constructed of one-course concrete using a 1:2:4 mix.
B. 
The foregoing specifications are subject to change by the Superintendent of Highways at any time.
A. 
Pavement specifications. In lieu of the specifications as provided in § 181-19 hereof, where building permits on streets included in Subdivision (e) of Section 280 of the Town Law are applied for, or where subdivision maps have previously been filed after approval by the Planning Board and building operations have been abandoned or discontinued and the performance bond given in connection therewith is still in full force and effect, the minimum type of road which may be installed in such cases shall consist of the subbase being rolled with a ten-ton roller, then six inches of road cinders rolled to compaction of five inches with a ten-ton roller. Upon this material, 1/2 gallon bituminous material per square yard to be covered with pea gravel grit shall be applied and then rolled. After allowance of 24 to 48 hours for the material to set, an application shall then be made of 3/4 gallon bituminous material per square yard to be covered with three-eighths-inch dolomite stone and rolled.
B. 
The foregoing specifications are subject to change by the Superintendent of Highways at any time.
A. 
Work. Under this section, the contractor shall place standard-type sidewalk, curb or other, of the type called for, on typical section or as may be ordered by Engineer.
B. 
Concrete mix 1:2 1/2: 3 1/2. The concrete shall consist of a mixture of one part portland cement, 2 1/2 parts of fine aggregate and 3 1/2 parts coarse aggregate, broken stone or gravel, No. 3 size. The concrete shall be mixed in an approved batch mixer for 1 1/4 minutes after all the materials, including water, are in the drum.
C. 
Excavation. Excavation shall be made to the required depth, and the subgrade shall be compacted to a firm even surface. Driveways, sidewalks and aprons at driveways shall be six inches in thickness.
D. 
Forms. All forms shall be set true to line and grade and in a rigid position. The forms shall be left in place until the concrete has set sufficiently so that they may be removed without injury to the concrete work.
E. 
Placing and finishing concrete. Concrete shall be placed only on a moist subgrade. The subgrade shall not be soft, muddy or frozen when the concrete is placed. The concrete shall be placed in the forms immediately after mixing, thoroughly compacted by tamping or other approved method and struck off with a template to the required grade. Concrete for curb shall be spaded to allow a smooth surface adjacent to the forms. As soon as the condition of the concrete permits finishing, the surface shall be wood-troweled (float finish) in a circular motion and finished to the approval of the Inspector. Concrete sidewalk shall be marked off in blocks of the same length as the sidewalk width. Expansion joints shall be 1/2 inch thick and spaced every six blocks or approximately every 24 feet. Edging should be finished with an approved edging tool with a 1/4 inch radius.
F. 
Curing. After the initial set has taken place, all concrete shall be covered and kept moist for a period of 48 hours. Concrete curb shall be protected from traffic for a minimum period of seven days.
A. 
Catch basins. Catch basins, manholes, seepage drains and reinforced concrete pipe or any other drain appurtenances shall be built as shown on the filed plan. They shall be built of eight-by-eight-by-sixteen-inch concrete block and conform to the intent of the standard county and Town drawings. Inside dimensions shall be five feet by six feet three inches with a minimum depth of five feet six inches or as determined. The six-foot-three-inch dimension shall be laid from curb to property line. The first three courses of the basin shall be seepage courses laid as directed. The catch basin top shall be cast reinforced concrete 1:2:4 mix three-fourths-inch stone, eight inches thick, and shall constitute the sidewalk area as to finish and alignment. Reinforcing bars shall be five-eighths-inch bars spaced six inches on center two ways, with a maximum of two inches' protection on the bars on the bottom side. The top shall include a standard-type light manhole ring and cover and a standard curb inlet casting. The existing conditions for drainage and appurtenances shall determine when and where catch basins, combined catch basins and manholes with or without connecting pipe shall be constructed.
B. 
Concrete pipe. Underdrains (seepage drains) shall consist of porous concrete drainpipe with tight joints, Walker Cement Products Co., or approved equal. Porous concrete pipe shall be . . (inches to be determined by conditions of a particular area) inches in size, inside diameter, connected from basin and/or manhole to the proper lines and grades and in such manner as directed by the Town Engineer or his representative.
C. 
All work relative to drains and drainage conditions shall be under the supervision of the Town Engineer or his representative and to his satisfaction and approval. The Town Engineer shall reject material or design in accordance with the purpose and intent of these specifications, if he deems necessary. The developer or contractor shall carry out the provisions of these specifications in accordance with the plans and such other instructions of the Town Engineer.

Any person or persons, association or corporation committing an offense against this Part 2 or any section or provision thereof is guilty of a violation punishable by a fine not exceeding $250 or imprisonment for a period not exceeding 15 days for each such offense, or by both such fine and imprisonment.

A. 
Street signs and street markers and/or directional and safety signs shall be placed and set where directed by the Town Engineer.
B. 
One street marker shall be placed at each intersection and shall be located, where possible, on the northeast corner of said intersection at the junction of the highway lines. Street markers bearing the names of streets shall be on metal brackets with metal posts or metal brackets affixed to metal ornamental light poles as directed by the Town Engineer. The type of sign or signs to be erected shall be as directed by the Town Engineer in accordance with the following specifications:
(1) 
Metal brackets shall be all cast aluminum with a five-and-twenty-five-hundredths-inch blade holder. The signs shall consist of a six-inch extruded blade, with an estimated weight of 0.951 pounds per linear foot. The blade shall be covered with green high-intensity reflective sheeting, and lettering shall be silver high-intensity. All work shall be in accordance with the Manual of Uniform Traffic Control Devices.
(2) 
Metal posts shall be plain, round, straight one-piece aluminum, standard weight alloy 6063-T6, 2.500 inches inside diameter by 2.875 inches outside diameter by 10 feet long. One three-and-four-tenths-by-eight-inch aluminum shaft sleeper and hole (snug fit) and one one-half-inch weep hole (not cut through) shall be provided at the bottom of each. One one-sixteenth-inch chamfered edge shall be provided on the top side of each pole. The sleeper shall be four inches from the bottom of pole, and the weep hole shall be two feet six inches from the bottom of the pole. The pole shall be two feet two inches in the ground with a concrete footing.
(3) 
Dead-end streets shall be equipped with the standard conventional street marker, set as directed by the Town Engineer.
C. 
Whenever conditions warrant the erection of additional signs for particular purposes and conditions which are not specified by this section, the developer or contractor shall place and erect such signs as directed by the Town Engineer which are in reasonable compliance with law.
