Transportation of hazardous materials — See Ch. 142.
Any person or persons or company who causes or contributes to the cause of a spill of a toxic or flammable liquid which causes a danger or is reportable pursuant to federal or state law must expeditiously report the spill to the Police Department of the Borough of Carteret at the earliest practicable moment. Said report shall include information as to the nature of the liquid spilled, the quantity and location and whether the situation is under control or assistance may be required.
The Police Department then shall forthwith advise the borough's First Aid Squad, Fire Department, Health Department, Emergency Management Coordinator and Mayor of said information so that each of these agencies can act accordingly.

The agencies and officials named in this chapter, together with each and every member of the Borough Council, shall have the right to investigate any spill in order to protect the general safety and welfare of the citizens of the Borough of Carteret.

Any failure on the part of the person or persons or company who caused or contributed to said spill to report the same immediately in accordance with this chapter shall subject such person or persons or company, upon conviction thereof, to the penalties set forth in § 1-17 of this Code.
