As used in this article, the following terms shall have the meanings indicated.
LANDLORD
The owner or owners of the real property upon which a trailer is located by virtue of a lease agreement.
TENANT
The owner or owners of the trailer which is located on property owned by the landlord and who enters into a lease agreement with the landlord.
TRAILER
A modular home, otherwise known as a "trailer" or "mobile home," being temporary in design, but by its nature being permanently situated at a rented location.
TRAILER PARK
A grouping of ten (10) or more trailers owned by tenants situated on property owned, operated and maintained by the landlord.
The provisions of this article shall be applicable to every trailer within the borough and to any person maintaining, operating, conducting or permitting any such trailer park and shall also be applicable to any person living or sleeping in any trailer, as well as to all persons violating or contributing to the violation of any of the provisions of this article.
It shall be unlawful for any person to operated or maintain or to offer for public use within the borough any trailer park without first obtaining a license and complying with applicable regulations.
A. 
An application for a license shall state the following:
(1) 
The name and address of the owner of the premises.
(2) 
An agreement to comply with all provisions and regulations now or hereafter promulgated.
(3) 
A resume of the sewer, water and garbage facilities, along with an administrative plan for maintenance of the facility.
(4) 
A site plan of lots for trailers and a maximum number of trailers to be accommodated.
B. 
Each application shall be accompanied by an inspection fee of two hundred dollars ($200.).
C. 
The above procedure shall be followed in the event the expansion of any park exceeds twenty-five (25) trailers in any two-year period.
The Council or its duly authorized representative shall investigate the premises and determine whether the trailer park or the site selected therefor conforms to the requirements of this article, the rules and regulations of the Board of Health and the laws of the State of New Jersey. No license shall be issued unless the trailer park and the site selected therefor comply with such requirements and meet the approval of the Council. The Council may, at its discretion, approve or reject any proposed trailer park or plan for expansion.

A. 
The annual license fee for each trailer park shall be increased from $300 to $3,000 for each block of 100 trailer spaces or fraction thereof.
B. 
The per-trailer fee shall be increased from $60 per year or part thereof to $200.
C. 
The foregoing increases shall be effective for the 2005 - 2006 renewal year and thereafter.
A. 
Each landlord shall maintain a registry of each trailer in the park. Said list shall be kept up to date and contain the following information:
(1) 
Name of tenant.
(2) 
Names of all occupants of the trailer.
(3) 
Emergency phone numbers of tenants.
(4) 
Emergency phone numbers and contact person of landlord.
B. 
Said list shall be placed on file with the Police Department and the Fire Chief, or Battalion Chief.

A. 
Each landlord shall maintain the trailer park in a clean, safe and orderly manner consistent with the laws and ordinances of the State of New Jersey and Borough of Carteret. In addition, all roadways, parking areas, sanitary systems and lighting is to be kept in good repair and working order.
B. 
Each trailer park shall be laid out, maintained and arranged in rows abutting or facing a roadway not less than fifteen (15) feet in width providing unobstructed access to a public street.
C. 
The trailer park shall be equipped with access to water, sewage and electrical systems.
D. 
It shall be unlawful for any landlord to sell or to cease operating a trailer park without complying with the following:
(1) 
The landlord must notify each tenant in writing and by certified mail of his intention to cease operation of the trailer park at least one (1) year prior to the date operation of said park will cease. Notice shall specifically state the date operations will cease. Any change in said date will require a new notification at least one (1) year prior to.
(2) 
The landlord shall make every effort to aid the tenant in relocating their trailer to another park.
(3) 
The landlord shall be required to pay all relocation costs of any tenant who is forced to relocate by reason of the park ceasing operation who is sixty-five (65) years of age or older and/or physically handicapped.
E. 
Each tenant must be provided with a complete set of rules and regulations as defined in this article.
F. 
Every trailer park shall be established upon a well-drained area, and the premises shall be properly graded so as to prevent the accumulation of storm and casual waters.
G. 
An adequate supply of pure water for drinking and domestic purposes shall be supplied to meet the requirements of each trailer.
H. 
Dogs shall not be permitted to run at large in the park at any time.
I. 
Each trailer shall maintain garbage receptacles with close-fitting covers for refuse, ashes and rubbish, and such garbage receptacles shall at all times be kept in a clean and sanitary condition.
J. 
It shall be unlawful for any wastewater or material from sinks, showers or other plumbing fixtures in any trailer park to be disposed of upon the surface of the ground, and all such fixtures, when in use, must be connected with the sewer system of the borough.

It shall be the duty of the Board of Health, Fire Chief, or Battalion Chief, and the Police Department to enforce the provisions of this article. The Health Officer or other representative of the Board of Health and the members of the Police Department shall have the right and are hereby empowered, subject to their detail, from time to time, to enter upon the premises of any trailer park operated within the borough and inspect the same and all accommodations connected therewith.
Any person operating or maintaining for public use with the borough any trailer park may transfer the license to another person, provided that:
A. 
The licensee make application to the Council for transfer, setting forth therein the name of the trailer park and its location, the name and address of the transferee, the names and addresses of the principal stockholders of the corporation, the name and address of the agent of the corporation and the date of incorporation. In addition thereto, the application shall specifically set forth his consent to transfer the license.
B. 
The application shall be referred to the Chief of Police for investigation in accordance with the requirements of § 164-3.

With regard to mobile home/trailer parks, no more than one liquified natural gas (propane) tank used for residential heating purposes may be placed on a tax lot within the Borough of Carteret. The provisions of this article shall not apply to such existing propane tanks.

The provisions of this article notwithstanding, if the owner(s) or renter(s) of a mobile home or residential trailer wish to convert to propane as a means of heating said residential unit or wish to replace an existing propane tank used for such purpose, the owner(s) or renter(s) of said unit may do so for a period of up to 36 months following the passage of this article. Before the owner(s) or renter(s) of a mobile home or residential trailer may install a new propane tank to be used to convert the heating system of said unit to be fueled by propane gas, the property owner of the tax lot upon which the mobile home or residential trailer is located shall be required to obtain site plan approval from the Planning Board for said purpose.
