Zoning — See Ch. 162.
In all residential districts as designated on the Borough Zoning Map,[1] solid fences which exceed three feet in height from the ground are expressly prohibited, except as hereinafter provided.

Solid fences up to a maximum of six feet in height may be erected in the following instances:
A. 
When they are erected in compliance with Ordinance No. 849, which requires the erection of fences for swimming pools.[1]

B. 
When they are erected for the enclosure of patios, but only in the area from the rear building line to the rear property line.

C. 
When they are to be erected on a property line but only on either side property line from the rear building line to the rear property line and on the rear property line, if written permission of the affected adjacent property owner(s) is obtained and presented to the Building Inspector upon application for a permit for the erection of such fences. The above-mentioned written permission of the adjacent property owner(s) shall not be required if the fence is erected a minimum of six inches from the property line described hereinbefore.

In all residential districts as designated on the Borough Zoning Map,[1] open or ornamental fences may be erected to a height not exceeding six feet from the ground only from the rear building line to the rear property line and then across the rear property line, and to a maximum height not exceeding four feet from the rear building line to the property side of the sidewalk line and then across the property side of the sidewalk line. Open or ornamental fences shall have a ratio of at least one part solid to three parts open.

Fences required under Ordinance No. 849 for the purpose of enclosing either an in-ground swimming pool or an aboveground swimming pool are expressly excepted from the requirements of this chapter and are to be governed by Ordinance No. 849.[1]

In all residential districts of the Borough, no fence shall be erected in the front yard area of any lot, tract or parcel of land, unless it is natural living vegetation (i.e., plants, trees, hedges) of which the height shall not be greater than four feet. For a living fence (vegetation) no permit is required.

Any person violating any of the provisions of this chapter shall, upon summary conviction before a District Justice, be sentenced to pay a fine of not more than $500 for each and every violation. Each day the violation occurs shall be considered a separate offense.

If any paragraph, subparagraph, sentence, clause, phrase, or any portion of this chapter be declared invalid or unconstitutional by a court of competent jurisdiction, or of any provision of any part of this chapter as applied to any particular situation or set of circumstances be declared invalid or unconstitutional, such invalidity shall not be construed to affect the remaining portions of this chapter not so held to be invalid, or the application of this chapter not so held to be invalid.

This chapter repeals any prior ordinances, resolutions or parts thereof which are in conflict or are inconsistent herewith with respect to the Codified Ordinances of the Borough of Glenolden and provisions of Chapter 71. All other existing ordinances, resolutions or parts thereof not inconsistent herewith shall remain in effect.
