The following terms shall have the meanings indicated:
BOROUGH
The Borough of Glenolden, Delaware County, Pennsylvania.
LOITERING
Any or all of the following: remaining idle essentially in one location; lingering; spending time idly; loafing or walking about aimlessly in a vicinity or neighborhood; or "hanging out."
PUBLIC ACCESS PROPERTY
Any public street, alley, sidewalk, park, playground, ball field, recreation areas, commons, or parking lots; or any private parking lots open to public use (regardless of the private parking lot establishment is open or closed for business).
No person shall loiter in any public access property in such manner as to do any or all of the following:
A. 
Create or cause to be created a danger of a breach of the peace;
B. 
Create or cause to be created any annoyance to any person or persons;
C. 
Obstruct the free passage of pedestrians or vehicles; and
D. 
Obstruct, molest, or interfere with any person lawfully in any public access property as defined in § 106-1 of this chapter. This shall include the making of unsolicited remarks of any offensive, disgusting, or insulting nature or which are calculated to annoy or disturb the person to or in whose hearing they are made.
Whenever the presence of any person in any public access property is causing or is likely to cause any of the conditions enumerated in § 106-2 of this chapter, any police officer may order that person to leave that place. If that person shall refuse to leave after being ordered to do so by any police officer or if that person returns and continues to violate the conditions enumerated in § 106-2 of this chapter after being ordered to leave that place by any police officer (regardless of the time elapsed from the initial order), that person shall be in violation of this section.
Any person who shall violate any provision of this chapter, shall, upon conviction thereof, be sentenced to pay a fine of up to $500 and costs of prosecution or, in default of payment of same, imprisonment for a term not to exceed 90 days.
Any police officer is hereby authorized to act on behalf of the Borough.
