GENERAL REFERENCES

For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:
COMMERCIAL
Structures used for nonresidential purposes, including stores, businesses and offices; however, excluding industrial and institutional establishments.
CONTAINER
A. 
Any metal or plastic barrel, bag or other receptacle with proper lid which, together with its contents, does not weigh more than 50 pounds or measure more than 45 gallons.
B. 
Any securely tied bundle not weighing more than 50 pounds and not measuring more than three feet in diameter or length.
CURBSIDE PICKUP POINT
A point at the curb in front of the building or dwelling; provided, however, that no containers shall at any time be placed in the street or roadway nor be placed upon the sidewalk in such a manner as to obstruct or interfere with pedestrian passage.
DUMPSTER
Any receptacle which, together with its contents, weighs more than 50 pounds or measures more than 45 gallons and is used by any person, store, business, office or any other profit or not-for-profit business or organization pursuant to an agreement with a private, solid waste collection firm for the collection of garbage and trash, which shall include, but not be limited to, solid waste types 10, 13 and 13C as defined by the New Jersey Department of Environmental Protection.

GARBAGE
Includes any type of table waste, refuse, rubbish, garden refuse and ashes, but excluding dirt, building and construction materials used in the construction or structural alteration of a building.
PICKUP UNIT
Each unit within a structure used as a separate residence, business or office, for example:
A. 
Single-family residence equals one unit.
B. 
Three-family residence equals three units.
C. 
Shopping center with 12 shops equals 12 units.
D. 
Building with two stores and three apartments above the stores equals five units.
RESIDENTIAL
Structures used primarily for human habitation, and includes single-family and multifamily dwellings and apartments above commercial establishments.
TOWNSHIP
The Township of Wyckoff, New Jersey.
TRASH
Includes Christmas trees, household furniture, window air conditioners, screens and screen doors, dishwashers, refrigerators, washing machines, dryers, stoves and other appliances and fixtures, tires, dismantled swing sets, bicycles and other recreation equipment.
A. 
The owner or occupant of any property, prior to the placement for collection of garbage and trash, shall store the same in such a manner as not to become a nuisance to the owners or occupants of any adjacent property.
B. 
Owners or occupants of all properties shall provide containers for the collection of garbage at their own cost and expense.
C. 
Containers, together with their contents, shall not weigh more than 50 pounds or measure more than 45 gallons.
D. 
Refuse, rubbish or garden refuse placed for collection in securely tied bundles shall not weigh more than 50 pounds and not measure more than three feet in diameter.
E. 
No garbage shall be collected from containers which are rusted or damaged to the extent that they are not structurally sound.
No person shall set or place any container or trash at the curbside pickup point for collection before 6:00 p.m. on the date prior to the collection day nor allow any empty containers to remain at the curbside pickup point as herein defined after 7:00 p.m. of the day of collection.
All garbage and trash set or placed for collection shall be placed at the curbside pickup point; however, in no event shall the same be placed in the street or roadway nor be placed upon the sidewalk so as to interfere with pedestrian passage. Where a sidewalk runs parallel to a street or roadway and the space between the same is insufficient for proper placement of a container or item of trash as provided above, such container or trash shall be placed for collection at a point on the opposite side of said sidewalk.

The Township shall provide curbside service once per week for all residential, commercial properties and churches, with a maximum collection of six containers per week. The Township Committee may, by resolution, determine any changes or deviations from this service. The schedule of collections shall also be determined by resolution of the Township Committee.

Any person shall be permitted to make special arrangements for the collection of additional containers or additional collections with a private solid waste collection firm licensed by the Public Utilities Commission. Such collections shall be made in accordance with the provisions of this chapter and all other ordinances, rules and regulations of the Township where applicable. In the event that the amount of garbage and trash to be set and placed for collection exceeds the limited service provided by the Township as set forth in § 161-5 herein, the owner or occupant of the property shall place the garbage and trash in a dumpster, as defined herein and of the type provided by a private solid waste collection firm, and shall make special arrangements with a private solid waste firm as provided above. Failure to comply with the forgoing shall subject the owner or occupant of the property to the penalties set forth in § 161-9 herein and shall, within 24 hours from receipt of written notice, authorize the Township to contract with a private solid waste collection firm to collect and dispose of said garbage and trash and assess the cost thereof to the owner or occupant, and the assessed cost shall become a lien and tax on said property and shall be part of the taxes to be levied and assessed thereon and enforced and collected with interest by the same officers and in the same manner as other taxes. The Tax Collector shall provide notice of this provision on each certificate as to liability for assessment of municipal improvements issued by the Tax Office pursuant to statute.

The following regulations shall apply to the owner and/or the occupant of any property on which is located a dumpster as well as to owners and providers of dumpsters.
A. 
Prior to the placement for collection of garbage and trash, the same shall be placed and stored in the dumpster in such a manner as not to become a nuisance to the owners or occupants of any adjacent or surrounding properties and so as not to litter other properties.
B. 
A dumpster shall be equipped with a lid, which shall be closed and secured at all times except while garbage and trash are being placed in the dumpster or being collected from the dumpster.
C. 
No garbage or trash shall be placed outside of a dumpster or on top of the closed lid of a dumpster.
D. 
No dumpster shall be placed, set, removed, filled or emptied on Sundays or between the hours of 6:00 p.m. and 6:00 a.m. Monday through Saturday.

The provisions of this chapter shall be administered and enforced by the Wyckoff Zoning Enforcement Officer, Township Engineer, Building Inspector, Sanitarian, Health Officer, any Wyckoff police officer or any other municipal enforcement officer designated by the Township Committee to enforce this chapter.

Any person who violates any provision of this chapter shall, upon conviction, be subject to a fine of not more than $500 or to imprisonment for not more than 90 days, or to both fine and imprisonment.

No person, business or corporation shall collect or cause to be collected garbage, trash, or construction debris, whether from container, dumpster, or otherwise, on any property on Sundays or between the hours of 6:00 p.m. and 6:00 a.m. Monday through Saturday.

An ordinance requiring dumpsters and other refuse containers that are outdoors or exposed to stormwater to be covered at all times and prohibits the spilling, dumping, leaking, or otherwise discharge of liquids, semiliquids or solids from the containers to the municipal separate storm sewer system(s) operated by the Township of Wyckoff and/or the waters of the state so as to protect public health, safety and welfare, and to prescribe penalties for the failure to comply.
For the purpose of this article, the following terms, phrases, words, and their derivations shall have the meanings stated herein unless their use in the text of this article clearly demonstrates a different meaning. When not inconsistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4)
A conveyance or system of conveyances (including roads with drainage systems, municipal streets, catch basins, curbs, gutters, ditches, man-made channels, or storm drains) that is owned or operated by the Township of Wyckoff or other public body and is designed and used for collecting and conveying stormwater.
PERSON
Any individual, corporation, company, partnership, firm, association, or political subdivision of this state subject to municipal jurisdiction.
REFUSE CONTAINER
Any waste container that a person controls, whether owned, leased, or operated, including dumpsters, trash cans, garbage pails, and plastic trash bags.
STORMWATER
Water resulting from precipitation (including rain and snow) that runs off the land's surface, is transmitted to the subsurface, is captured by separate storm sewers or other sewerage or drainage facilities, or is conveyed by snow removal equipment.
WATERS OF THE STATE
The ocean and its estuaries, all springs, streams and bodies of surface water or groundwater, whether natural or artificial, within the boundaries of the State of New Jersey or subject to its jurisdiction.
A. 
Any person who controls, whether owned, leased, or operated, a refuse container or dumpster must ensure that such container or dumpster is covered at all times and shall prevent refuse from spilling out or overflowing.
B. 
Any person who owns, leases or otherwise uses a refuse container or dumpster must ensure that such container or dumpster does not leak or otherwise discharge liquids, semiliquids or solids to the municipal separate storm sewer system(s) operated by the Township of Wyckoff.
A. 
Permitted temporary demolition containers.
B. 
Litter receptacles (other than dumpsters or other bulk containers).
C. 
Individual homeowner trash and recycling containers.
D. 
Refuse containers at facilities authorized to discharge stormwater under a valid NJPDES permit.
E. 
Large bulky items (e.g., furniture, bound carpet and padding, white goods placed curbside for pickup).
This article shall be enforced by the Township Engineer, Zoning Enforcement Officer, Property Maintenance Officer, Recycling Coordinator, Construction Code Official or the Police Department of Township of Wyckoff.
Any person(s) who is found to be in violation of the provisions of this article shall be subject to a fine not to exceed $2,000.
