A code regulating retail food establishments and fixing penalties for violations is hereby established pursuant to N.J.S.A. 26:3-69.1 to 3-69.6. A copy of said code is annexed hereto and made a part hereof without the inclusion of the text thereof herein.
The said code established and adopted by this article is commonly known as the "Retail Food Establishment Code of New Jersey (1965)."
Three copies of the said Retail Food Establishment Code of New Jersey (1965) have been placed on file in the office of the Sanitarian of this local Board of Health upon the introduction of this article and will remain on file there until final action is taken on this article for use and examination by the public.
Any person who violates any provision of or order promulgated under this article or code established herein shall, upon conviction thereof, be liable to a penalty of not less than $5 nor more than $500 for each violation. Each day a particular violation continues shall constitute a separate offense.

As used in this article, the following terms shall have the meanings indicated:
FOOD HANDLING ESTABLISHMENT
Any fixed or mobile restaurant, in which food or drink is prepared or processed for human consumption, be it for on- or off-premises consumption.
SUPERVISOR
Any person charged with the responsibility of overseeing the operations, including the supervision of employees engaged in the preparing or processing of food or drink intended for human consumption, be it for on- or off-premises consumption.
A. 
All retail food establishments are required to have in their employment a supervisor who has a valid food handler's certificate on the premises at all such times the establishment is in operation or open for business. Establishments shall provide personnel to an approved food handler training course in the following manner:
(1) 
Take out and miscellaneous establishments: one person per shift.
(2) 
Restaurants of 49 seats and below: one person per shift.
(3) 
Restaurants of 50 seats and above: two persons per shift.
(4) 
Supermarkets: one store manager and one person from each department per shift.
(5) 
Schools: one person per shift.
(6) 
Short- and long-term care facilities: one person per shift.
B. 
A food handler's certificate, renewable every two years, shall be issued to any person successfully completing a course of instruction given or approved by the Township of Wyckoffs Health Officer. All courses shall be in compliance with current New Jersey State Department of Health guidelines for food course training. The cost of the course is $30 and shall be borne by the applicant.
No person to whom a food handler's certificate is issued shall give, loan, transfer or permit the same to be used by any other person, for any purpose whatsoever.
Any establishment not in compliance with any provision of this article shall be subject to fines/cost not to exceed $1,000. The Board of Health may suspend the retail food establishment license of any person, partnership, corporation or establishment in violation of this article for a period not more than three days, pursuant to the authority of the Board of Health to license and regulate food establishments as provided by N.J.S.A.A 26:3-31(c).
