As used in this chapter, the following terms shall have the meanings indicated:
LIVE POULTRY
All manner of domestic and wild birds, and includes fowl, chickens, turkeys, ducks, geese and all other domesticated birds, but does not include those birds which are household pets.
PERSON
Includes a corporation, organization, firm or partnership as well as an individual.
No person shall keep or maintain any live poultry within the Borough of Prospect Park without first having secured a written permit therefor from the Board of Health, granted by said Board at one of its regular meetings. No live poultry shall be kept in any building any part of which is used, occupied or capable or being occupied by human beings, nor shall any live poultry be allowed to run at large in what is commonly known as "poultry runs."
No poultry shall be housed in other than a structure that is elevated on cement or concrete piers, having a minimum clearance thereunder of at least 18 inches. Said building shall be rat-proofed in accordance with that portion of Conservation Bulletin No. 19, issued by the United States Department of the Interior, Fish and Wildlife Service, that pertains to rat-proofing of poultry houses, which provisions of said bulletin are on file with the Clerk of the Board of Health and are made part of this chapter. No part of any poultry house shall be closer than 20 feet to any building that may be used as a dwelling or to any church, school or public building nor within 20 feet of any street line.
The permit fee to keep live poultry shall be $2 per annum, and permits shall expire on the 30th day of April in each year and shall be renewed annually. Any permit may be revoked or renewal thereof denied by the Board of Health, after public hearing, for any violation of this chapter.
The provisions of this chapter shall not apply to poultry stores or persons dealing in live poultry, but in such cases a special permit for operating such structure shall be issued by the Board of Health under such restrictions and conditions as the Board of Health may deem necessary to preserve the public health.
A permit to operate a live poultry establishment shall be $25 per year, and each permit shall expire on the 30th day of April in each year.
Any person who shall violate any of the provisions of this chapter shall be punished upon conviction thereof by a fine not exceeding $50 or imprisonment not exceeding 30 days, and every day of such violation shall be deemed to be a separate and distinct offense.
