As used in this chapter, the following terms shall have the meanings indicated:
APPROVED LOCKING DEVICE
One which will effectively deny entrance by any unauthorized person.
CONSTRUCTION
The building or installing of a new swimming pool or the enlarging of an existing swimming pool or any of its facilities.
PERSON
Includes corporations, companies, associations, societies, firms and partnerships as well as individuals.
A. 
All swimming pools shall be located in the rear yard only. No swimming pool shall be located so that any portion thereof is within 10 feet of any building of an abutting property, nor shall any pool be located within three feet of the side line of the lot or within three feet of the rear line of the lot.
B. 
A site plan shall be submitted to the Building Inspector for his approval, and no building permit shall be issued unless the plan meets the requirements of this chapter.
A. 
All private swimming pools now existing or hereafter constructed, installed, established or maintained shall be enclosed by a permanent fence of durable material at least four feet in height which shall be so constructed as not to have openings, mesh, holes or gaps larger than four square inches in any dimension except for doors and gates, and if a picket fence is erected or maintained, the horizontal or vertical dimensions shall not exceed four inches. All gates used in conjunction with the fence shall be equipped with approved locking devices and shall be locked at all times when the private swimming pool is not in use. All existing private swimming pools shall be fenced within 60 days after passage of this chapter.
B. 
All portable pools greater than 18 inches in height aboveground, unless enclosed by a fence of the type and dimensions hereinabove specified, shall be either emptied when not in use or unattended or covered with a suitable, strong protective covering securely fastened or locked in place when not in use or unattended.
C. 
Nothing in this section shall apply to pools having sides extending four feet or more above grade, provided that the stairs or other means of access to the pool are removed when not in use or are effectively closed with a gate as provided hereinabove which shall be closed and securely latched when such pool is not in use.
D. 
It shall be deemed that there is sufficient compliance with this section when the owner's entire property or entire yard is completely enclosed by a fence and gate of the type above mentioned.
A. 
No artificial lighting shall be maintained or operated in connection with a private swimming pool, wading pool or portable pool in such a manner as to be a nuisance or an annoyance to neighboring properties. Such lighting shall not shine directly upon any abutting property. No unshielded light shall be permitted.
B. 
Electrical fixtures, wiring and installation thereof used in connection with pools shall conform to the standards of the National Board of Fire Underwriters for electrical wiring and apparatus.
Provision shall be made for drainage of the pool and for backwash water disposal. No nuisance to owners of an abutting property or to the public shall be created by virtue of disposal of such wastewater from any pool.
No private pool shall be used at any time in such manner as to create a nuisance or disturbance to other properties in the vicinity or to the inhabitants thereof.

Any person or persons violating any of the provisions of this chapter shall, upon conviction thereof, be liable to the provisions stated in Chapter 1, Article II, General Penalty.
