This article is ordained to control, regulate and license the conducting of sales commonly referred to as "garage sales" within residential areas of the Borough. Such sales are hereby defined as the sale of household merchandise, such as surplus household and other accessory items.
A. 
It shall be unlawful for any person or persons to conduct any sale commonly known as a "garage sale" without first having received a license.
B. 
The Borough Clerk is hereby authorized to issue such a license. The license shall be issued for a period not to exceed three consecutive days (Sunday excluded) after the person or persons have made application to the Borough Clerk setting forth the name and address of the applicant and date of sale. Only two licenses shall be issued within any one-year period per household. For purposes of this section, "household" shall mean an authorized dwelling unit within the Borough.
C. 
No sale shall be conducted except during the hours of 8:00 a.m. to 1/2 an hour after sunset.
D. 
The Borough may authorize by resolution up to two Borough-wide garage sales annually.
E. 
The Mayor and Council is herby authorized to determine the amount of the fee for the license. The license fee shall be waived by the Borough to the participants of the Borough-wide garage sale. However, all participants in the Borough-wide garage sale are still required to obtain a license for same from the Borough Clerk.
It is not the intention of this article to change or amend Chapter 235, Land Development.
Any person violating any of the provisions of this article shall, upon conviction thereof, be liable to the provisions stated in Chapter 1, Article II, General Penalty.
