It shall be the duty of every owner or occupant to keep the trees, shrubs and other vegetation on his property and the property abutting or bordering on any public street trimmed so as not to obstruct the sidewalk or roadway. All overhanging limbs shall be at least eight feet above the sidewalk and 13 feet above the roadway. All diseased, dead or dying trees shall be removed leaving a stump no higher than ground level.
When the Borough determines that there is a violation of this article, notice shall be served on the property owner or owners that they shall have five days to correct such violation. If, after said five-day period, the owner or owners shall refuse to correct such violation, the Borough shall cause the removal of such violation and assess the costs thereof against the adjoining land. All assessments shall be made and collected and taxes levied as provided by law.

Any person violating or failing to comply with any of the provisions of § 358-29 of this article shall, upon conviction thereof, be liable to the provisions stated in Chapter 1, Article II, General Penalty.
