As used in this article, the following terms shall have the meanings indicated:
PARK or PARKING
A. 
When permitted, means the temporary stopping of a vehicle, whether occupied or not, off the roadway. "Roadway" is the part of a highway used for vehicular travel.
B. 
When prohibited, means the halting of a vehicle, whether occupied or not, except momentarily for the purpose of and while actually engaged in loading or unloading property or passengers.
STAND or STANDING
When prohibited, means the halting of a vehicle, whether occupied or not, except momentarily for the purpose of and while actually engaged in receiving or discharging passengers.
STOP or STOPPING
A. 
When required, means complete cessation of movement; and
B. 
When prohibited, means any halting, even momentarily, of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control sign or signal.
Wherever a space is marked off on any street for parking of an individual vehicle, every vehicle parked there shall be parked wholly within the lines bounding that space, and no person shall park a vehicle or allow it to remain parked otherwise.
A. 
No person shall display any vehicle for sale or rental upon any street or public parking lot in the Borough.
B. 
Any person who violates any provision of this section shall be fined not less than $100 nor more than $1,000 for each offense. A separate offense shall be deemed committed each day or portion thereof that such violation exists.

Borough Council has reserved certain areas for special purpose and special permit parking. These areas are intended to accommodate such use as short-term truck and commercial vehicle loading, public transportation operations, and portions of residential sections where regulation of parking demand to supply needs to be regulated. The following are established as special purpose parking zones and/or special permit parking zones, and no person shall park a vehicle or allow it to remain parked in any such zone, except as specifically provided for that zone:

The intent of this section is to help facilitate the movement of a Borough resident who is handicapped, physically disabled or challenged in his/her efforts to move freely and without undue hindrance while entering or leaving a vehicle at his/her home.
A. 
Handicapped permit. A handicapped parking zone is for the sole use of a Borough resident, residing at a property immediately adjacent to the handicapped parking zone, with such physical disabilities verified by a recognized physician in that field, as the inability to walk, difficulty walking, reliance on walking aids, blindness and visual impairment, deafness and hearing impairment, incoordination, reaching and manipulation disabilities, lack of stamina, difficulty interpreting and reacting to sensory information, and extremes of physical size, or a person with a vehicle properly tagged, licensed and recognized by the Department of Transportation as a caregiver for such handicapped person.
B. 
Special handicapped parking zones. A handicapped resident of the Borough, or an agent thereof, may submit an application to the Code Enforcement Department, requesting the installation of a handicapped parking sign in order to designate a special handicapped parking zone along a residential street, adjacent to the property lines of a home occupied by such handicapped person, in order to facilitate the movement of such handicapped person at the marked location.
C. 
Definitions specific to handicapped parking section.
(1) 
Interchangeability. Words used in the present tense include the future; words stated in the masculine gender include the feminine and neuter; the singular number includes the plural and the plural, the singular.
(2) 
The following words and phrases, as used in this article, shall have the meanings ascribed to them in this section, unless the context indicates a different meaning:
BOROUGH
The Borough of Yeadon.
BOROUGH ENGINEER
The person charged with representing the Borough on any engineering matters affecting the Borough.
BOROUGH SECRETARY
The Borough Secretary or Assistant Secretary of the Borough of Yeadon.
CODE COMMITTEE
As appointed by the Borough Council, charged with the enforcement of this article.
CODE OFFICIAL
The Director of the Department of Code Enforcement or person designated by him/her, charged with the administration and enforcement of this article or his duly authorized representative.
DEPARTMENT
The Department of Code Enforcement of the Borough of Yeadon.
HANDICAPPED PARKING ZONE
For the purpose of enforcing this article, the terms "handicapped parking," "handicapped spot," "handicapped space" and "handicapped zone" shall be interchangeable and shall have the same meaning when applied to this article, and shall be used to describe a reserved parking, stopping or standing area for the sole use of automobiles operated by a handicapped person or a person who is a caregiver for the handicapped resident residing in the property immediately adjacent to the handicapped parking zone; provided that the vehicle is legally recognized and tagged with a handicapped plate, as a vehicle used by or for the transportation of a handicapped person.
OFF-STREET PARKING
A concrete or paved area or drive which is privately owned and not part of the public way; and is legally recognized by the Borough, for the parking, stopping, standing or conveyance of a vehicle, solely for use by the owner and those having express or implied permission from the owner for such use.
OWNER
Any person, agent, operator, firm or corporation having a legal or equitable interest in the property, including the guardian of the estate of any person or the executor or administrator of the estate of such person, if ordered to take possession of real property by the court.
PARK or PARKING
When permitted, means the temporary storing of a vehicle, whether occupied or not, off the roadway. When prohibited, means the hauling of a vehicle, whether occupied or not, except momentarily for the purpose of and while actually engaged in loading or unloading property or passengers.
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind.
PROPERTY
For the purpose of enforcing this article, a property shall be considered a residence located on a parcel of land with property lines immediately adjacent and common to the proposed or actual handicapped parking zone.
PROPERTY OWNER
The person listed as the owner of such real estate property as named on any title, deed, Delaware County tax records or Yeadon Borough tax records.
D. 
Handicapped parking applications. The request must be on a form provided by the Code Official. The application shall set forth the following information:
(1) 
A proof of handicapped registration from the Pennsylvania Department of Transportation.
(2) 
A doctor's note describing the type of handicap, to include an endorsement that a handicap space is needed for medical reasons.
(3) 
An explanation of a particular parking problem which requires the reservation of a handicapped space.
(4) 
The signature of the property owner granting permission for the Borough to enter the exterior of the property in order to inspect the existing conditions of the property.
E. 
Borough review and licensing.

(1) 
Upon receipt of all required fees and a completed application, the Code Department or the Borough Engineer shall review the application, inspect the property, interview the applicant and perform a traffic/parking study and report such findings to the Borough Council.
(2) 
Within 60 days of receipt of the request, the Borough Council shall review the application and findings of the Engineer and/or Code Department and determine whether the problem is sufficiently severe to warrant the reserved handicapped space. Borough Council shall approve or deny an application by vote at a duly called and noticed meeting of Council.
(3) 
The presence of off-street parking shall be prima facie grounds for denying such permit. However, the Borough Council may grant such permit if it finds that the circumstances necessitate a handicapped parking zone despite the presence of off-street parking.
F. 
Renewals.
(1) 
All handicapped permits must be renewed 30 days prior to their expiration. All renewal applications shall contain all information as listed in Subsection D of this section.
(2) 
The Code Department shall inspect the property for changes in status that could impact the need for the handicapped parking zone, and shall report such findings to the Code Committee.
(3) 
The Code Committee shall review the renewal application and determine if the applicant is still in need of the handicapped parking zone.
G. 
Handicapped parking permit fees. Permit fees will be applied as per the Borough Fee Schedule as adopted in Chapter 150, Fees, of this Code.
H. 
Handicapped permit revocation. A handicapped parking permit shall be revoked or renewal applications denied if:
(1) 
A renewal application and/or all required fees are not submitted by the renewal due date.
(2) 
Any facts contained in the application were deliberately misrepresented by the applicant.
(3) 
In the opinion of the Code Committee, the need for the handicapped space no longer exists due to recovery, relocation, death, modification to the property that alleviates the need for such space or any misuse or misrepresentation of the space.

B. 
As used in this section, "noncommercial van" means an unlettered or unmarked van with side windows and with a gross weight of under 9,000 pounds, provided that such van is not used to conduct any business or trade.
C. 
Nothing contained herein shall prevent Fire Department, Police Department or Highway Department vehicles or ambulances from parking when such vehicles are answering emergency calls.
D. 
Nothing contained herein shall prevent active members of the Fire Department from parking an unlettered or unmarked vehicle with a gross weight of less than 7,000 pounds on any street in the Borough, provided that such vehicle is used to respond to an emergency alarm, and provided, further, that a permit has been issued by the Chief of Police to the operator of such vehicle.
E. 
Nothing contained herein shall prevent trucks from parking on such streets between the hours of 6:00 a.m. and 9:00 p.m., provided that such trucks are actively rendering a commercial service to a premises located on that street, or during the hours of 9:00 p.m. to 6:00 a.m. of the following day while making an emergency repair.
F. 
A vehicle owner may request a one-day exemption. Such an exemption may be granted by the Chief of Police or his or her designee.
A. 
No person shall park a vehicle, other than a passenger car, noncommercial van or motorcycle, in a private driveway or off-street area in any residentially zoned district, except as follows:
(1) 
The gross weight of the vehicle does not exceed 10,000 pounds.
(2) 
The location in which the vehicle is parked is an improved road surface.
(3) 
The number of vehicles permitted is one.
B. 
For the purpose of this section, "parking" means leaving any such vehicle unattended for a period in excess of two hours.
C. 
A leisure or recreational vehicle with a weight classification of one ton or less, equipped with a camper body used only for recreational or leisure purposes, is exempt.
D. 
For the purpose of this section only, a notice of violation shall be sent to the owner of the property for the first offense. The notice shall be sent by registered letter. Future violations will be cause for the issuance of a citation.
E. 
As used in this section, "noncommercial van" means an unlettered or unmarked van with side windows and with a gross weight of under 10,000 pounds, provided that such van is not used to conduct any business or trade.
F. 
A property owner may request a one-day exemption. Such an exemption may be granted by the Chief of Police or his or her designee.
A. 
No person shall repair any vehicle upon any street in the Borough, except in an emergency situation.
B. 
The following are not considered emergency repairs and are expressly forbidden:
(1) 
Fluid changes;
(2) 
Brake repairs or replacement;
(3) 
Tune-ups;
(4) 
Body repairs;
(5) 
Engine repairs or overhaul;
(6) 
Repairs to exhaust systems; and
(7) 
Repairs to chassis and frame.
C. 
Any person who violates any provision of this section shall be fined not less than $100 nor more than $1,000 for each offense. A separate offense shall be deemed committed each day or portion thereof that such violation exists.
A. 
No person shall repair a vehicle on residential property, or on commercial property where the occupation is not specifically licensed to perform automotive repairs or bodywork, when such repair is offensive and detrimental to the property of another person or tends to cause substantial diminution in the value of the property of another person.
B. 
This section shall not apply to a vehicle being repaired on residential property and which is not readily visible from a public place or surrounding private property.
C. 
Any person who violates any provision of this section shall be fined not less than $100 nor more than $1,000 for each offense. A separate offense shall be deemed committed each day or portion thereof that such violation exists.
Unless otherwise specified, any person who violates any provision of this chapter shall be fined not more than $15 and costs. It shall be the duty of the police officers and parking enforcement personnel of the Borough to report to the Chief of Police all violations of any provision of this chapter, indicating, in each case, the section violated; the license number of the vehicle involved in the violation; the location where the violation took place; and any other facts that might be necessary in order to secure a clear understanding of the circumstances attending the violation. The police officer or other person making the report shall also attach to or place upon every such vehicle a notice stating that the vehicle was parked in violation of this chapter. The notice shall contain instructions to the owner or driver of the vehicle that if he or she reports to the office of the Chief of Police and pays the sum of $10 within 48 hours after the time of the notice, or if he or she places the sum of $10, enclosed within the envelope provided, in any of the special parking fine boxes installed at various locations within the Borough, that act will save the violator from prosecution and from payment of the fine and costs prescribed in the first sentence of this section.
