The purposes of the NC Neighborhood Commercial
District are to provide retail and service facilities which serve
primarily the daily needs of the immediate surrounding neighborhood
and to encourage attractive, compact retail commercial development
in locations close to the residences serviced.

A building may be erected and used, and a lot or premises may
be used, for any of the following purposes and no other:
A. Permitted principal uses. In the NC Neighborhood Commercial District,
land, buildings or premises shall be used by right only for one or
more of the following:
(1) Retail stores designed primarily to provide retail goods to residents
of the immediately surrounding area, and with a gross floor area not
in excess of 2,500 square feet, excluding dollar stores, thrift stores,
and produce stores;
(2) Residences, not located on the first floor of the structure, with the minimum floor space per unit as stated in §
300-33C(2)(e);
(4) Professional or business offices, agencies or studios; and
(5) Confectionery, bakery, pastry, candy or ice cream shops making goods
only for retail on the premises, specifically excluding automobiles,
trucks and other similar vehicles and road stands and booths from
which food or food products are sold.
B. Accessory uses. The following may be permitted as accessory uses
incidental to permitted principal uses:
(1) Accessory uses on the same lot with and customarily incidental to any of the permitted uses set forth in Subsection
A hereof; and
(2) Storage within a completely enclosed building in conjunction with
a permitted use.
C. Uses by special exception. The following uses shall be permitted
as special exceptions when authorized by the Zoning Hearing Board:
(1) Theaters; specifically excluding any adult entertainment uses.
(4) Amusement centers, specifically excluding any adult entertainment
uses.
D. Conditional uses. The following uses shall be permitted as conditional uses when authorized by the Borough Council on the basis of the standards set forth in Article XVIIand provided that the condition set forth at Subsection
E is met. If the condition set forth in Article XVIIis not met, then the use shall not be permitted.
(1) Personal service shops, including tailors, barbers, beauty salons,
fortune-telling services, dressmaking, shoe repair or similar uses;
(4) Banks or other financial institutions;
(5) Dollar stores, thrift stores, and produce stores;
(6) Laundry or dry-cleaning establishments;
(7) Off-street parking, subject to its primary use to serve one or more
permitted uses;
E. To prevent the over-concentration of certain uses and to promote a complementary mix of uses that will generate pedestrian foot traffic and promote the economic health of the NC District, the uses authorized pursuant to section Subsection
D above shall be permitted by conditional use only if no identical or similar use is located within a five-hundred-foot radius from the proposed use.
All off-street parking shall be restricted to the rear of structures or to lots within walking distance of such structures and subject to Article
XIV.
No building may be erected, altered or used,
and no lot or premises may be used, for any trade, industry or business
that is noxious or offensive by reason of odor, dust, smoke, gas or
noise, or that is dangerous to public health or safety. No internal
combustion engine shall be used unless objectionable noise and vibration
are eliminated and it is equipped and supplied with an effective muffler
or silencer.
There shall be a buffering requirement of five
feet along every side and rear property line which abuts a residence
district.
Signs shall be permitted in accordance with Article
XIII.
