A. 
A certain document, copies of which are on file in the office of the Borough Manager, being marked and designated as the International Private Sewage Disposal Code, 1995 edition, and the 1996 Supplement thereto, as published by the International Code Council, Inc., BOCA, ICBO and the SBCCI, are hereby adopted as the Private Sewage Disposal Code of the Borough, subject to any amendments or deletions that may be provided by the Borough, for the control of private sewage disposal systems as therein provided. Each and all of the provisions, penalties and conditions of said International Private Sewage Disposal Code, and such 1996 Supplement, are hereby referred to, adopted and made a part hereof as if fully set forth in this article.
B. 
As the International Private Sewage Disposal Code and the 1996 Supplement thereto, as set forth in Subsection A hereof, are amended, supplemented or added to, such amendments, supplements or additions shall also be established as the law of the Borough. As any future amendments or editions of the International Private Sewage Disposal Code, and the 1996 Supplement thereto, as described in Subsection A hereof, are published, they shall also be adopted by the Borough.
The following sections of the International Private Sewage Disposal Code, and the 1996 Supplement thereto, as adopted in § 246-12, are hereby amended as follows:
Section 101.1. Title. Insert "Borough of Yeadon" as the name of the jurisdiction.
Section 106.4.2. Fee schedule. Insert the following: "Permit fees for connecting with the sewers of the Borough shall be in accordance with the schedule as determined from time to time by the Borough Council."
Section 106.4.3. Fee refunds. Insert "seventy-five percent" in two locations.
Section 108.4. Violation penalties. Replace with the following: "Whoever violates or fails to comply with any of the provisions of this code shall be subject to the penalty provided in § 246-15 of the Code of Yeadon."
Section 108.5. Stop-work orders. Insert "five hundred dollars ($500.00)" in two locations.
This article is intended to supplement all existing State Department of Environmental Protection (DEP) regulations, as amended. Where a conflict exists between State DEP standards and this article, the Code Enforcement Officer shall decide which standards shall apply.
Unless otherwise provided, whoever violates or fails to comply with any of the provisions of this article, including the provisions of the International Private Sewage Disposal Code, and the 1996 Supplement thereto, as adopted in § 246-12, shall be fined not less than $100 nor more than $1,000 or imprisoned not more than 10 days in the Borough Lockup or not more than 30 days in the county jail or workhouse, or both such fine and imprisonment, for each offense. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
