The Affirmative Action Commission is hereby established as an operating Board of the City of Orange, New Jersey.
The Affirmative Action Commission shall consist of no more than nine (9) members, seven (7) appointed by the Council, with each Council member receiving one (1) appointment, and two (2) appointments by the Mayor. The original appointees shall serve in the following manner three (3) members for one-year terms, three (3) members for two-year terms, and three (3) members for three-year terms. Upon completion of the initial terms, all terms shall be for a period of three (3) years. The Mayor's initial two (2) appointments shall be for three (3) years. All appointments to fill vacancies shall be for the unexpired term. The members shall serve without compensation.

There shall be an Affirmative Action Officer charged with the duties of overseeing the implementation of the Affirmative Action Plan. For administrative purposes, the Affirmative Action Officer shall be assigned to the Office of the Mayor.
A. 
It shall be the policy of the City of Orange to provide equal employment opportunities to all without regard to race, color, religion, national origin, political ideology, marital status, sex, age and mental or physical handicap except where it is based on bona fide occupational qualification. This policy applies to recruiting, hiring, placement, compensation, promotion, transfer, layoff, dismissal, seniority, benefits, training and all other terms and conditions of employment in accordance with the Affirmative Action Plan attached hereto and made part hereof (Revised Majority Report).[1]

B. 
The City of Orange shall undertake and commit itself to an Affirmative Action Plan. This program will outline specific action steps to ensure equal opportunity in employment, establish parity of representation in all departments and categories and promote the full utilization of the capabilities of all employees of the city. The development of the program shall begin immediately. It shall be continuously monitored and periodically updated until parity is established.
C. 
The City of Orange's Minority Business Enterprise, Women Business Enterprise, Veteran Owned Business Joint-Venture and Set-aside program as outlined in § 7-9 to 7-12 of the Municipal Code shall also be incorporated into the Affirmative Action Plan.

The City of Orange shall undertake and commit itself to the Affirmative Action Plan as set forth in § 7-4 herein.
Board and Commission appointments shall be made in accordance with the intent of this program.
All banks and savings and loan institutions which are depositories for City deposits shall be Affirmative Action lenders and employers.
Pursuant to the provisions of N.J.S.A. 40:69A-181, ten (10) copies of the Affirmative Action Plan and Policy for the City of Orange, which need not be published, shall be placed on file in the office of the City Clerk for examination by the public as long as this chapter is in effect.
