Pursuant to the provisions of Title 40 of the Revised Statutes
of New Jersey, as amended, and in particular the provisions of an
Act of the Legislature of the State of New Jersey entitled the "Solid
Waste Management Authorities Law" P.L. 1968, c. 249, effective August
16, 1968 (N.J.S.A. 40:66A-32 et seq.), the City of Orange hereby creates,
together with such other municipalities of the County of Essex who
adopted within the 1974 calendar year a substantially similar ordinance,
a public body corporate and politic under the name and style of "The
West Essex Solid Waste Management Authority" (hereinafter referred
to as the "Authority").
The Authority shall acquire, construct, maintain and operate
a solid waste disposal system for the use and benefit of the municipalities
who are members of the Authority and for the use of such other municipalities
and other persons as may be authorized by the Authority. Such solid
waste disposal system shall include all improvements, works, facilities
and property, real and personal, and rights therein and appurtenances
necessary, useful or convenient for the treatment, deposit and disposal,
including incineration, recycling or other reduction processes, of
solid waste, garbage, ashes, trash or any solid refuse matter not
usually collected, carried away and disposed of by a sewerage system.
The solid waste disposal system of the Authority shall be jointly
operated by the members of the Authority as provided in the aforesaid
Act of the Legislature of the State of New Jersey, and such Authority
shall be authorized and empowered by the terms and provisions of a
joint contract to be entered into by all of the municipal members
to have and exercise all of the powers and authority of the Authority
as provided in said act of the Legislature of the State of New Jersey,
except as said statutory powers may be limited by the joint contract.
The joint contract shall provide that the initial costs and
expenses of the Authority shall be shared by the contracting municipalities,
proportional to their population in the most recent census.
Each municipality who is a member of the Authority and a party
to such joint contract shall appoint by resolution one (1) representative
to the Authority and one (1) alternate representative to serve in
the event of the absence or inability to act of the representative.
The terms of the representative and alternate of the respective municipalities
shall be three (3) years.
The joint contract shall be subject to approval by resolution
by the City Council of the City of Orange prior to its execution by
the Mayor and City Clerk of the City of Orange.
